0:40 -- $800 increase in the annual cost of pest control management services provided to the city by Ehrlich Pest Control. The increase is due to the addition of the Blossom Field House and 4470 Oakes Road to the city’s annual pest control contract. Approved 1:155:20.

1:19 -- $3,500 increase in the purchase order to West Side Roofing Co. for repairs to the north hip section of the Human Services Building roof. The increase was due to the contractor’s error in estimating supplies and materials. Even with the increase, the job still costs less than the next lowest bid on the project. Approved 1:55:48.

2:52 – Acceptance of proposals for employee health benefits from these companies:
■ Medical Mutual of Ohio for employee health care insurance, administration of the employee health care insurance program and provision of health care stop loss insurance.
■ Delta Dental for employee dental insurance.
■ Lincoln National Life for employee life insurance.
Council approval at 1:43:10.

13:30 – Amendment of the city’s 2023 appropriations ordinance to make necessary appropriation and revenue adjustments. Approved 1:42:10.

16:34 – Appointment of Alexander J. Haffner and William J. Lovell as full-time firefighter/paramedics. Haffer has worked part time with the Brecksville Fire Department, and Lovell comes from the city of Aurora. Approved 1:31.

28:00 -- $3062.40 to EMSAR to replace the PowerLOAD control board assembly unit for one of the city’s ambulances. PowerLOAD is a system used for stretchers. Approved 1:53.05.

29:30 -- $4,273.05 to KMS Paint and Body for body repairs to one of the city’s police vehicles, which was rammed twice by the suspect’s vehicle during a chase. Approved 1:53.44.

31:04 – Approval of the purchase of an electric towable lift for the Service Department from Bobcat of Cleveland through Sourcewell (formerly the National Joint Powers Alliance). A $23,000 safety grant from the Ohio Bureau of Workers’ Compensation will cover most of the cost, with the city paying the balance of about $7,000. Approved 1:46:26.

32:49 -- $8,375 to Old Dominion Brush Co. for a replacement hydraulic valve assembly for one of the city’s leaf machines. Approved 1:54:18.

40:26 – Executive session to discuss matters pertaining to the appointment to boards and commissions and the hiring of full-time employees.

1:47:20 – Approval of two variances proposed by the Board of Zoning Appeals:
■ Variances to the side-yard and front-yard setbacks for an addition at 5400 Valley Parkway.
■ Variances to the rear setback and minimum parking stalls at 8006 Katherine Blvd.

1:49:47 – Approval of a pickleball court and landscaping buffer easement at 2383 Springside Oval, contingent on approval by the city’s Horticultural Department and the neighbor to the south.

1:50:39 – Approval of equipment upgrades to the Verizon cell tower at 6898 Mill Road, contingent on a structural review. The upgrades comprise a 155-foot antenna and ground equipment. Council Member Ann Koepke abstained.

1:51:38 – Approval of a façade design for Office Building I at Valor Acres.

1:52:28 – Announcement that Dr. Craig Hileman has been sworn in as a member of the Human Services Advisory Board.

1:59:07 – Announcement that Metro Health’s Life Flight ground unit is being stationed in Brecksville. While this is part of the Life Flight system, it does not involve a helicopter.

2:02:25 – Public comments were made by Brecksville residents Steve Schadler first, and then Joshua Folk regarding a deferred prosecution agreement involving Council Member Dominic Caruso, which was reported recently by Cleveland.com (https://www.cleveland.com/business/2023/10/brecksville-councilman-dominic-caruso-may-face-trespassing-criminal-damaging-charges-if-he-violates-deferred-prosecution-agreement.html). The agreement was signed Dec. 30, 2022. It involves a dispute between Caruso, owner of Caruso’s Coffee, and the owner of a neighboring business.

Schadler, a candidate for City Council, pointed out that the city’s charter lists as reasons for removal of a city official include malfeasance, nonfeasance or gross misconduct. He said the charter does not require that the official be convicted and said he believed Caruso committed a “deliberate criminal act.” He notes that alternative options for discipline include removal from his leadership position and/or a formal censure. He asked what the council members knew about the incident and when they knew it. No council member responded.

Folk spoke next and said he came to the council meeting to confront Caruso but noted Caruso was not in attendance. (Caruso had been excused from the meeting so he could attend his son’s varsity soccer playoff game.) In a contentious exchange, Folk asked Mayor Jerry Hruby what he knew about the incident and asked, “Why did it not come out for a year?”

Hruby responded that he knew Caruso had been interviewed by police at the time but that he considers the dispute a private matter. He noted Caruso has not been charged with any crime. “I have no further comment,” he said.

“I figured you would hide behind that,” Folk responded.

Council Member Brian Stucky commented that he has known Caruso since ago 12. “I respect Dominic Caruso,” he said.

0:40 - $6,267 for supplies and materials for repair of the Human Services flat roof. Passed 2:26:50.
1:14 - $5,000 increase for swimming pool chlorine for the remainder of 2023 ($4,800 for the Community Center swimming pool and $200 for the Human Services pool). The increase is due to the rising cost of chlorine. Passed 2:27:20.
2:45 - Sale of 2.42 acres on Noble Park Lane to Morel Landscaping L.L.C. Passed 2:12:43.
3:55 – Purchase of 50 replacement desktop computers for $63,140 and four laptop computer for $6,048.92 from Dell Marketing LP, to be used by various city personnel. Passed 2:11:56.
5:44 - Payment of monthly bills for professional services for total of $36,568.01. Passed 2:28:00.
7:04 – No objections raised to transfer of two liquor permits from Compass Group USA to Hesta Hospitality L.L.C. Public hearings waived. Passed 1:44:16.

1:00 - Discussion of new garage doors for the building and engineering garage ($6,600) and incurred cost overruns with parking lot fixes totaling ($15,000).

2:20 - Discussion of fixing chilled water pumps at city hall ($3,200).

3:05 - Community center tile repair project discussion. Tiles and grout are in and around the natatorium ($19,000).

4:05 -Removing and replacing air filters in the police arms range (3,420). Passed 1:31:40.

5:04 - Request for tax advances from the county to the city.

6:10 - Current property tax rate will stay at 8.21 mills and certifying them to send to the county officer.

7:20 - Civil Service commission is requesting $3,150 for polygraph testing for police candidates, increase to budget for the purchase of new more advanced time clocks.

10:00 - A $69,000 grant for body cameras was obtained.

21:40 - Miller Road detour expenses totaling $4,865.39, and increase of past approved expenses.

23:00 - Purchase of 2 portable traffic signals for $65,000. Passed. 1:32:30

25:15 - Reimbursement of sick time to 2 employees who were injured while working in the service department. Passed both. 1:51:05.

26:40 - Mayor discusses a petition sent by Glenwood residents about a lack of police and speeding on the street. Speed bumps were also requested, as well as radar signs and more. Mayor alludes that the issue is likely local residents on Glenwood. Mayor and the police chief will send the residents a letter soon. Mayor does not understand how they determined the speeders were not residents to the street. Radar records will be reviewed.

1:30:45 - Second herring accepting the bid for the Blossom Hill Trail Improvements. Passed, next meeting will be the final hearing.

1:33:12 - authorization for current expenditure adjustments for the current year budget. Passed.

1:34:10 - resolution making advances between funds. Passed.

1:35:00 - resolution County fiscal officer advance sums allowed form tax levies. Passed.

1:36:00 - accepting amount and rates by the budget commission and authorized and certifying tax levies to the county.

1:36:40 - purchase of only 1 Ford police SUV from Montrose Ford and 3 police interceptors form non state vendors exceeding the original price form Montrose Ford. Passed

1:38:10 - Mayor to participate in the Ohio Public Works and transportation improvement program for the Riverview road slippage.

1:39:45 - BZA appeals - approval for signage for Barber Dale’s on Brecksville Road with several deviations. Laser

1:41:01 - BZA appeals - approval of mass grading and level for Lavender Lane and phase 2 roadway and subdivision 2 and storm water management. Passed.

1:43:30 -Increase of $1,000 for police community outreach materials. Passed.

1:44:10 - Increase to cement contractors for $4,865.39 for phase 2.

1:44:45 - Thank you to the city hall team for the grant money of $271,808 for the Riverview slippage.

1:45:50 - Glenwood construction is coming to an end and looks good

1:46:15 - $6,600 increase for garage doors for. Passed.

1:53:45 - Police chief Korinek - shared story about a man brandishing a fire arm at family in town. The flock camera system helped catch this person retuning to town.

1:55:05 - Chief Zamiska - shared the upcoming clam bake event details and benefits. A save the date is Sunday 10/1 for the Safety Service fair from 10:30am - 3pm.

1:55:55 - Mayor Hruby - Thank you for attending the Joe Vadini field dedication and Ralph DeSantis dedication of fields. Shred day is 9/9. There will be an initiative to place signs on historic hills in town (3 Hills), much there is at Old Town. 9/26 there will be a replacing of the cornerstone time capsule at City Hall, to be opened in 50 years. Ask people to slow down while driving with school back in session, calling out parents who drive to school.

Glenwood and Miller Road updates are noted below, and just want to draw attention as it is something of high interest to many. Noted at the 34 Minute mark below.

0:43 - 130 replacement trees for Fall planting (about $200 per tree) for a purchase requisition of $26,169. Passed 1:52:10.

1:28 - Leaks on Human Services building and it needs to be reshingled on the north hip section. Purchase requisition to Westside Roofing $13,750. Passed 1:52:50.

2:25 - Recaulking the north face of the Human Services building where water was getting in. Purchase requisition to Captain Caulking and Building Restoration for $42,030. Passed 1:53:15.

3:20 - Pipe insulation (2,100 ft) at Blossom Hill building 7 to replace old asbestos covered pipes. Purchase requisition to Superior Industrial Insulation for $21,310. Passed 1:53:45.

3:50 - Adjustments to community center pool pack to help with humidity and condensation control and with a negative pressure. Purchase requisition to Pier Associates for $5,712. Passed 1:54:11.

4:30 - Accepting of a proposal for a structural investigation at Central School property. Focus is on the back older section that faces Arlington. $5,000. Passed 1:32:30.

6:40 - Approval for the mayor to enter an agreement with the Board of Health for Cuyahoga County to provide services. Occurs annually. Passed 1:33:00.

7:15 - Accepting proposal for the Civic Plus to manage municipal code, agendas, minutes and videos for $8,600 per year starting December 2023 through 2026. Same price as in the past. Passed 1:38:35.

8:50 - Charter amendment booklet and mailing. $4,200 to HKM to be mailed to every resident prior to charter amendments going into the ballot this fall. Should be in mailboxes next week (9/25). This is required by the charter to be published and sent. Passed 1:54:55.

10:30 - Increase to an already existing purchase requisition by $6,000 for data conversion for the GIS system with new software. Passed 1:55:50.

11:20 - Purchase requisition for $40,696.06 to Superium LLC for renewal of the annual maintenance for the previous finance software system and current building software systems. Maintenance charges - $30,586.07. This is due to modules that are still using old software and haven’t transitioned to the new software yet. Passed 1:56:30.

13:00 - Appropriations for the city expenditures. General Fund, adjustment of $2,000 for service department trailers. Also the previously mentioned GIS system. An error in the general municipal improvement fund budget. Need to increase to pay off interest in a note. Passed 1:34:00.

13:55 - Standard 4th quarter necessary budget transfers. Passed 1:35:00.

14:45 - Miller & 77 interchange notes went to market. Coupon of 4.625% and yield of of 3.97%. This was better than those who prices before us, in large part due to our credit rating.

16:35 - Consideration of 2 trailers for the service department for $9,140 for 2 x 16ft landscaping trailers. Passed 1:48:20.

17:05 - Consideration for a non-traditional police vehicle for detectives. Currently have 3 that are 12 years old. Three old vehicles were traded in for $8,000 and kept under the $36,000 budget. New amount for purchase is $32,752 for this vehicle. Passed 1:49:00.

19:55 - Entering a MOU with the Cuyahoga Valley Career Center to provide a school resource officer with them split 50/50. This helps fill a void they have. Applied for a grant to help with this but it is pending. Grant could cover $120,000 over 3 years. CVCC will cover half of the current cost. Passed 1:39:20.

21:30 - Replace the order for 3 Tahoes with Lally Chevrolet. Nothing binding, but this is proactive to ensure the city is in line to receive these. Can cancel.

23:25 - Brecksville has been award $40,000 for the purchase of body warn cameras for our police. This totals over $109,000 in grants covering 95% of the cost.

25:20 - Chippewa Road sidewalk grant from NOACA from Cinnabar to Riverview. This grant requires a 20% local match. Authorization for the mayor to apply for this grant. Passed 1:35:50.

26:50 - Looking to obtain funding through the state capital budget to connect the Riverview and Chippewa intersection to the Station Road trailhead. Mayor will apply through the office of State Senator Cirino. Passed 1:37:05.

28:20 - Brecksville Road resurfacing must have a public notice. Information is on the website and comments can be taken via email.

29:00 - Blossom Hill Trail update. By the next city council meeting we should have progress through the city of Cleveland city council.

31:05 - NOACA board of directors approved the construction of a multi muse pathway connecting Valley Parkway to Miller road on Brecksville road and an enhanced bus shelter. Next is to submit to CMAC and ohio regional councils.

33:20 - Highland Drive sewer improvement project. Estimate is $205,000. Fixes and ongoing issue for years, goal is to complete it this year. Passed to put out for bid 1:49:37.

34:30 - Glenwood Trail, just need road stripes and signage, plus a few small items. Two change orders regarding a front yard drainage issue and an issue with fixing a hold Cleveland water drilled.

36:49 - Miller Road improvement project will be putting the curb lane up on the south side and progress should be mostly completed in roughly a month for the major part of it.

1:39:45 - BZA Appeals - 3 appeals total - variance to a maximum square footage and side yard setback for a shed on 7464 Old Quarry Lane. Passed

1:40:47 - BZA Appeals - maximum front yard setback of 135 feet to allow for 177 feet for a nonconforming house at 9261 Highland Dr. Passed.

1:41:35 - BZA Appeals - Maximum 192 SA feet for a shed to allow 484 sq foot shed with approval of arbor vitae for screening for a shed at 3911 Oakes Rd. Passed.

1:42:30 - Approval and permit for Master Pizza and Corradi’s scoops for a 26.35 sq ft sign and 23.65 sq ft sign non illuminated sign, which is over over the maximum allowed of 35 sq ft, and maximum of 1 sign per building to allow for 2 and to allow for a sign on the side of the building, not just the front. Variance also for maximum number of colors. Passed.

1:44:03 - Approval and permit for Barber Dale’s for a 9.72 sq ft window sign at 8920 Brecksville Rd, up from a maximum of 5 sq feet. Maximum sq ft variance from 100 sq. feet to 131 sq. feet. Passed.

1:45:23 - Lot consolidation and setback at 9135 and 9155 Highland Drive. Establish a 140 foot setback and to allow for irregular lot forms. Passed.

1:46:40 - Public hearing on October 5th at 7pm at City Hall to review the proposed request for a business plan development area for buildings C, D, E, F and H on Miller Rd and Brecksville Rd.

1:47:35 - Pool repairs are coming along nicely.

1:57:44 - Fire Chief Zamiska would like to thank all who attended the clam bake. Touch a Truck event is Sunday October 1st from 10:30-2pm.

1:58:35 - Report of the Mayor - Shred day collect 30,000 pounds of materials and 2 pickup trucks worth of goods for the pantry. May 11th and September 14th will be next year’s shred dates. Charter review commission will appear before council in the October 3rd meeting. October 1st 10:30-2pm is Touch a Truck and meet our first responders. September 26th at 5pm will be the replacement of the memory Bork into the 1971 cornerstone of City Hall. Announcing historic hill locations will be announced soon. Mayor loved seeing the biggest surprises from the time capsule.

2:06:00 - Scott Campbell - Wants council to approve 12 pickleball only courts. Cost is around $350,000-400,000, including a land purchase which may not be needed. Likely this is an overinflated price tag. Feels 12 is needed based on demand and population size. Discussion about other cities and what they have and difficulties pickleball players face in Brecksville.

Finance Committee (0:42)

• Consideration of approval for a blanket purchase order for operational costs share by the city at the Field House. Rachel added additional context regarding the increases to cover the bills through the end of the year. $23,000 for Electrical and $2500 for Water and Sewer. (1:20) Approved appropriation adjustments (1:33:40)

• Resolution for Mayor to provide a grant to the BBBH Community Awareness and prevention services for intervention services. Mayor added additional context (2:20). Further detailed and Approved (1:16:30)

• Ohio Ambulance Transportation premium pay program. Chief speaks about the details regarding how communities can receive money from the program which is in response to working during the pandemic.(4:20) Approved (1:15:15)

• Appropriations for current expenditures, specifically some expenses at the Field House (5:05) Approved (1:08:20)

• Ordinance to ensure payment of the project at the Miller Rd interchange. (5:45) Detailed Reading of this Ordinance and Approval (1:12:45)

Legislation Committee (8:14 called to order)

• First order is a transfer of a liquor permit to Township Catering Wine Room from Rustic Hills management, waiving the need for a hearing. (8:48) Approved (1:08:20)

Safety and Service Committee (9:55 Called to Order)

• Discussion regarding new police vehicles. Chief shared context regarding background on communication challenges with Ford and Ford Dealers regarding the logistics of this purchase and the need for the increased cost of $9,000 to support this purchase. Council needs to concur with this purchase as it isn’t coming from budget. Coming from a different fund (10:15).

Streets and Sidewalks Committee (15:32 Called to Order)

• Seeking approval for Audible Cross walk signals at Arlington/21/Brecksville Rd, City Hall Drive/ Brecksville Rd, and 82/Brecksville Rd to Greenwich Electric Inc. for installation. The estimated lead time is 4-6 months for poles. Monica discussed the Grant of $50,000 that we received for the project. (15:55) Approved (1:09:05)

• Blossom Hill trail project being moved to a First Reading not a bid as there are several easements as part of this project. Gerry adds additional context regarding the timing to get the easements needed by the water tower. There are no objections with the plan. It’s a matter of timing. The first reading is for the bid from Eclipse company at $593,014 (18:49) Approved to move to second reading (1:10:10)

• Gerry provides a detailed update on Miller road project. Complete closure of Miller Rd between Southpoint and Brecksville to ensure completion of a portion of this project. • Gerry provides an update on Riverview. Another slippage, south of 82 on Riverview, opening up some cracks in the pavement significantly, so decided to close the road. Looking at solutions to get this re-opened and then get repairs into the 2024 budget to fix next year (25:00)

• Daryl talks about Trike and Bike success. This year raised $42,000 and the Awarding of the $1.1 million urban pavement grant for sidewalks and repaving (27:20) Further discussion at (1:31:00)

Utilities Committee (28:14 called to order)

• Gerry provides update on Chippewa Rd. work. Project is moving along and mainline sewers should be done this month wrapping mid September. (28:37)

• Update on Glenwood. The contractor didn’t need to use a previously approved Change order, but they are looking at additional compensation for some additional components in the pavement portion. Goal would be to repurpose the unused change order. Motion to revise the change order. (29:33) Approved (1:32:30)
