Survivors of s*xual assault, abuse, harassment, and discrimination already carry so much. And yet, far too many are silenced again, not by their abusers directly, but by retaliatory defamation lawsuits designed to drain them financially, break them emotionally, and keep them quiet.
I know this firsthand. I lived it.
That's why I am standing fully, loudly, and unwaveringly behind the Speak Your Truth Act, landmark legislation that originated in California thanks to the tireless work of Victoria Burke, and is now being pushed nationwide.
This bill has already been enacted in California, Oregon, Connecticut, and Maine. And right now, fourteen more states, including Massachusetts, are fighting to pass it too.
What this act does is simple but transformative:
It protects survivors' First Amendment rights when speaking their truth publicly. It ensures that anyone who tries to silence a survivor through a defamation lawsuit must prove actual malice, that the survivor knowingly made false statements. And it holds bad-faith lawsuits accountable by requiring those who file and lose to cover the survivor's legal fees. Let me be clear:
Telling your truth is not defamation.
Surviving is not a crime.
And no one should be sued into silence for speaking about what happened to them.
