Orchard Park Police Chief Patrick M. Fitzgerald announced in a press release that a 45-year-old Orchard Park woman was critically injured after the e-scooter she was operating was struck by an SUV around 9:28 p.m. Wednesday, Oct. 8, at the intersection of South Buffalo Street and Armor Duells Road.

According to the release, the woman was unconscious and unresponsive at the scene and was treated by Orchard Park EMS before being transported to ECMC for treatment.

A preliminary investigation determined the SUV was traveling south on South Buffalo Street with a green light when the e-scooter entered the intersection eastbound on Armor Duells Road against a red light and was struck. Members of the Orchard Park and West Seneca police accident investigation units responded to reconstruct the crash.

Police said the SUV driver and other witnesses cooperated with investigators. Following the investigation, the e-scooter operator was charged with operating an electric scooter while intoxicated, a misdemeanor under New York State law, as well as failure to stop at a steady red signal and operating an e-scooter with no or improper manufacturing label.

The woman was released on appearance tickets and is scheduled to appear in Orchard Park Village Court on Nov. 6. Her identity is being withheld pending family notification.
