Leaks, rotted walls and structural damage have sparked a lawsuit by the Cleveland Institute of Music (CIM), which claims its Hazel Drive Apartments were built with serious defects by its contractors and architect.
The conservatory filed its complaint in Cuyahoga County Common Pleas Court on Aug. 29, alleging that water infiltration and other construction flaws have left the four-year-old building unsafe and in need of major repairs.
The apartments, at 1609 Hazel Drive, serve as housing for CIM students as well as those from nearby Case Western Reserve University (CWRU).
In the filing, CIM accuses contractors John G. Johnson Construction and Bowen Construction Services of “substantial defective workmanship” and claims architect Vocon Partners failed to properly monitor the project or flag problems during construction.
The school says the deficiencies include leaky vents, faulty window interfaces and rotting structural materials, issues that it argues should have been obvious to the project’s overseers. CIM is seeking damages of more than $25,000, plus interest and costs.
