I’m all for this being the law in the United States of Amerikkka. We all know the Yt man would never vote for this to happen. This would be the end of their race by all means. Unfortunately the constitution prohibits for a person that was never unalived during the assault. Hopefully Florida can make an example out of someone and the Supreme Court will reverse Kennedy v. Louisiana.
The Supreme Court PrecedentEighth Amendment Limits: The U.S. Constitution bans "cruel and unusual punishments". The Supreme Court ruled in the landmark 2008 case Kennedy v. Louisiana that the death penalty is unconstitutional for any crime against an individual that does not result in, or was not intended to result in, death.
Proportionality: The Court found that executing a non-homicide offender is a disproportionate punishment that violates the Eighth Amendment.
Practical and Legal ConcernsUnderreporting: Legal experts and child advocates argue that making child sexual abuse a capital offense can cause family members or victims to hide the abuse out of fear that a relative might be executed.
Increased Danger: If r**e and murder carry the exact same maximum penalty, perpetrators might be more inclined to kill their victims to eliminate the primary witness.
Trauma to the Victim: A capital trial forces a young victim to endure intense legal proceedings and recount severe trauma repeatedly.
