05/12/2026 61 ELECTRONIC ORDER denying 59 Motion for Default Judgment. Tulsa Nights Entertainment Group Inc. (Tulsa Nights) sued three defendants. Two of those, Spotify USA Inc. and Vydia Inc., are litigating.
Empire Distribution Inc. (Empire) is a no-show. So Tulsa Nights asked for a clerk's default at Doc. 60 and a moved for default judgment against Empire at Doc. 59. The problem for Tulsa Nights is that it brought some counts against all three defendants and the other two are litigating.
The Court cannot grant this motion and foreclose the litigation from the other two. Tulsa Nights may refile the motion for default judgment against Empire once the counts it is also litigating against the other two defendants are resolved.
