IHC Verdict on PTI 27 September Protest vs Government Road Blockades in Islamabad | Constitution, Section 144 & Citizens’ Rights Explained
The Islamabad High Court has issued a detailed 37-page judgment on PTI’s planned 27 September protest and long march. A larger bench headed by Chief Justice Sardar Muhammad Sarfraz Dogar ruled that no political party, political leader, provincial government or public office holder has a lawful right to occupy roads, highways, interchanges, toll plazas or public places in or leading to Islamabad in a way that blocks citizens’ free movement, trade, hospitals or schools.
Peaceful protest is a constitutional right. Besieging the capital is not.
That raises the question this video asks: if the court says no party can shut the roads, does the law give the government itself the right to seal Islamabad or any other city with containers, Section 144 and red-zone lockdowns?
Under the Constitution:

Article 15 protects freedom of movement throughout Pakistan
Article 16 protects peaceful assembly (subject to reasonable restrictions by law)
Article 25 promises equality before the law

No government, no office-holder and no party is above the Constitution. Restrictions on assembly must be lawful, necessary and proportionate — not a permanent siege of a city.
The Peaceful Assembly and Public Order Act 2024 requires prior permission for gatherings of more than 15 people in Islamabad and allows designated protest sites. Administrations also use Section 144 and container blockades in the name of public order. The IHC judgment now makes the same principle apply in both directions: public roads belong to citizens, not to political pressure and not to indefinite official shutdowns.
