VIDEOGRAPHERS NEEDED:

For most, Zoom is a great way to conduct depositions and does make it very convenient for all. However, doing video depositions via Zoom can be problematic from a videography standpoint.
With Zoom, the witness's video image is what it is. The videographer cannot fully adjust the quality of the video. In addition, if the witness's camera freezes or gets pixelated, that is how it will be recorded.
At Elite, while we do video depositions via Zoom, we always encourage our clients to do in person video depositions.
Why? Simply put...we control the video quality. We can zoom in and out, pan left and right and adjust our aperture or the room lighting.
If it is preferred that everyone appear via Zoom, we recommend at least having our videographer go to the witness's location. We can bring a laptop to connect everyone else in remotely.

Since all of our videographers are disinterested third parties and do not benefit from the outcome of your case, we often get asked questions such as "How do you think the witness did today?" or "Did you think the witness was lying?" etc. Our videographers will never answer any questions about your case.
We understand that this can be very frustrating and hope that you will understand that being a disinterested third party is extremely important to us and making statements, or giving opinions, about a case or a witness could be viewed as partiality toward one side or the other.

When it comes to distractions on the screen during video depositions, we often think about photos, papers and other things visible in the background.
One thing you may not think would be a distraction is the time/date stamp that appears at the bottom of the screen. The time/date stamp may cause a juror to concentrate more on the length of time the testimony takes rather than the content of the testimony.
Also, if there are exhibits that are zoomed in on, the time/date stamp may block an important part of the exhibit from being seen by the jury.
There are some courts that require a date/time stamp be visible; however, there are some that do not require it to be displayed on screen. For example, the Superior Court of New Jersey does not require a date/time stamp be visible on the screen during the video. So, the next time you do a video deposition, check that court's rules to see if you can eliminate the time/date stamp and make your video look cleaner and free of distractions.
