Is it legal to do tarot card readings in Pennsylvania?
Technically, NO. Selling or accepting money for tarot card readings and other forms of "fortune telling" is a crime in Pennsylvania.
A state law dating back to 1861 classifies pretending to tell fortunes for "gain or lucre" as a third-degree misdemeanor.
While this statute remains technically on the books and has occasionally resulted in police warnings for local businesses, the law is not frequently enforced
The enforceability of this law is heavily debated. It is currently the subject of ongoing legal challenges and legislative pushes to repeal the outdated ban.
Non-Enforcement: Due to the pending federal challenge, many police departments are hesitant to enforce the statute, fearing legal ramifications. But there are current ongoing cases
Under Pennsylvania Consolidated Statutes Title 18, Section 7104, fortune telling is classified as a third-degree misdemeanor.
House Bill 1562 was introduced to repeal Section 7104 status.
September 10, 2025: After being re-reported to the Rules Committee, the full House voted to lay the bill on the table, removing it from active consideration on the chamber floor.
Because the bill was laid on the table, it has not passed into law, and Title 18, Section 7104 remains active. While the bill could theoretically be removed from the table and brought back for a vote before the legislative session ends, the repeal is currently stalled. As a result, tarot card readings performed for financial gain are still technically a third-degree misdemeanor in Pennsylvania
