Captain Charles Raabe was a 19th-century French dressage master and a noted disciple of François Baucher. Raabe is remembered for codifying and furthering classical dressage techniques, particularly those related to work-in-hand and piaffe.
Key aspects of Captain Raabe's contributions to dressage:
Innovations in piaffe and the halt: He extensively studied horse locomotion and refined the method for achieving a square, collected halt and immobility. This involved using "half-steps" to properly align the horse's legs before halting and applying a steady pressure of the whip on the loins to signal the final halt command, a technique he called the "effet d'ensemble".
Work-in-hand: Raabe codified techniques for using a whip for work-in-hand to supple the horse before being ridden. This preparation helped achieve a collected and correct posture.
Continuation of the Baucherist system: As a follower of François Baucher, Raabe built upon and disseminated his system of haute école (high school) dressage, influencing subsequent masters and theorists.
Published works: His methods and theories were preserved in published texts on equitation. For example, his work was featured in L'art équestre and was re-published by Decarpentry, a later French master.

H. Dv. 12, the German Army Riding Regulation (also known as the German Cavalry Manual) published in German in 1937, is considered to be in the public domain according to German copyright law.
Why it's in the public domain
Official Work: It is considered part of a statute, ordinance, official decree, or judgment issued by a German authority or court (§ 5 Abs. 1 UrhG), according to Wikimedia Commons.
Historical Document: As a service regulation ("Dienstvorschrift") of the German Armed Forces (Wehrmacht), it falls under the category of historical documents considered official works, meaning its content is in the public domain.

In short, a copyrighted English translation does not preclude another person from creating a new, separate translation of the same German original work. Here's why:
The Original Work's Status is Key: The determining factor is whether the original German work is in the public domain or still under copyright.
Permissions Required for Copyrighted Originals: If the original German book is still under copyright, any new translation requires permission from the copyright holder of that original work. (Our new edition of H. Dv. 12 with commentary is copyrighted in Germany and we purchaed the English language publiction rights)
Public Domain Opens the Door: If the original German book is in the public domain (meaning its copyright has expired), then anyone can translate it without needing permission, and they can claim a copyright on their new translation.
Originality in Translation: Each translation is considered a derivative work and a separate copyrightable entity, provided it demonstrates a sufficient level of creativity and originality beyond a simple word-for-word rendition.
In essence, if the German original is in the public domain, you are free to create your own translation, and that translation will be considered a new work with its own copyright, regardless of previous translations. However, if the German original is still under copyright, you would need to secure permission from the copyright holder of that original work to create and distribute your translation.
