Good trouble.
BREAKING: Average Americans deal a crushing defeat to MAGA fascism as a D.C. grand jury refuses to indict the protestor who allegedly threw a sandwich at a federal agent in the street earlier this month.
And it gets even better...
In what The New York Time is characterizing as a "remarkable failure" by the U.S. attorney's office, the decision marks the second time in recent weeks that a grand jury has declined to indict someone accused of felony assault on a federal agent.
Under normal circumstances this growing trend would be remarkable and coming as it does amidst Trump's escalating fascist crackdown on the nation's capital, it's being interpreted by many as a referendum on the administration's flagrant authoritarianism. Americans are fighting back peacefully in the courtroom.
"It is extremely unusual for prosecutors to come out of a grand jury without obtaining an indictment because they are in control of the information that grand jurors hear about a case and defendants are not allowed to have their lawyers in the room as evidence is presented," Alan Feuer, Devlin Barrett, and William K. Rashbaum wrote in the Times.
The national mood has turned decisively against Trump's deployment of the National Guard to D.C. to combat an imaginary crime wave. A recent Reuters/Ipsos poll found that just 38% of Americans support the use of troops for law enforcement in D.C. One can reasonably conclude that many of the grand jurors oppose Trump's actions and saw a possible indictment as an implicit endorsement of them.
The grand jury's decision is all the more stunning because the alleged assaulter Sean C. Dunn was caught on video. The footage went viral on social media and many assumed that it would lead to a cut and dry conviction. The Trump administration clearly expected an easy win in the case, because they even posted a video of law enforcement officers heading to Dunn's apartment. As it turns out, they were counting their chickens before they hatched.
Dunn was originally charged on August 13th for allegedly throwing a sandwich at a Customs and Border Protection officer and yelling out "fascists" and "I don’t want you in my city!" His alleged words echo the sentiments of most D.C. residents right now.
On Monday, Trump's pet prosecutors also resorted to refiling a felony assault charge as a misdemeanor after failed three times to obtain an indictment against a woman named Sidney Lori Reid who was accused of hurting an FBI agent at a protest against Trump's immigration crackdowns.
“Three grand juries have now declined to indict Ms. Reid for felony assault on a law enforcement officer,” stated Reid's lawyers. “The U.S. attorney can try to concoct crimes to quiet the people, but in our criminal justice system, the citizens have the last word. We are anxious to present the misdemeanor case to a jury and to quickly clear Ms. Reid’s name.”
As Trump's military occupation of D.C. stretches on and its popularity sinks even further, we should expect more and more grand juries to join this trend. The American people have discovered a way to stand up in opposition to fascism and they're seizing it.
