A former Waco attorney who was facing life in prison without parole in a child s*xual abuse case instead received just 30 days in jail after pleading guilty to reduced charges, according to KWTX.
Adam Hoffman, 49, pleaded guilty to indecent assault and displaying harmful material to a minor, both Class A misdemeanors, as part of a plea deal with the Texas Attorney General’s Office.
Under the terms of the agreement, Hoffman will serve 30 days in jail beginning April 27, forfeit his law license for at least five years, and is banned for life from contacting the victim. He will not be required to register as a s*x offender.
Hoffman had originally been charged with continuous s*xual abuse of a young child, a first-degree felony carrying a minimum sentence of 25 years to life without parole.
According to testimony during his 2025 trial, the victim said Hoffman abused him repeatedly over a three-year period during sleepovers at Hoffman’s home, beginning when he was between 6 and 7 years old and continuing until he was 10. The victim also testified Hoffman threatened to shoot him if he told anyone.
Evidence presented at trial included hundreds of text messages between Hoffman and the child, as well as inappropriate images found on a phone Hoffman later gave to the victim, according to KWTX.
Hoffman’s first trial ended in a mistrial after jurors were deadlocked 7-5 in favor of conviction.
The plea deal came shortly before a second trial was set to begin. A judge initially pushed back on an earlier version of the deal that would have resulted in no additional jail time, questioning why the punishment was so minimal.
“So we are going from a first degree felony to Class A misdemeanors with one day served? Seriously? Someone needs to sell me on this because I’ve got a big problem with only one day,” Visiting Judge Roy Sparkman said.
Prosecutors said the agreement was reached after reviewing the evidence and considering the impact on the victim, who had already testified in court.
The victim’s mother said she was disappointed Hoffman would not face prison time but said it was important for her son to hear Hoffman admit guilt.
“We just wanted to hear him say that he really did it, that it’s true and we just needed to be done so we could move on,” she said.
She added that while the outcome was “a little devastating,” hearing Hoffman say “I’m guilty, I did it” helped bring closure.
The McLennan County District Attorney’s Office said it recused itself from the case for ethical reasons, and the Texas Attorney General’s Office handled the prosecution. The DA’s office later said it shares the public’s concern about the outcome.
“These types of cases are difficult to prosecute,” the office said, noting its unit handling crimes against children has a conviction rate of more than 90% and that typical sentences average more than 50 years in prison.
