New Hampshire’s new tiny-home law is HB 1681, signed July 15, 2026, and taking effect September 13, 2026. It establishes standards for tiny homes, tiny homes on wheels, and residential yurts. Official law⁠

The main points:

* Size: A tiny home is 600 square feet or less, excluding lofts, with permanent facilities for living, sleeping, cooking, eating, and sanitation.
* Residential use: Municipalities may permit them as a primary home on an individual house lot or as an ADU.
* Homes on wheels: Qualifying homes built on a trailer chassis are recognized separately from campers and RVs.
* Building requirements: State building-code requirements still apply, along with drinking-water and wastewater requirements.
* Off-site construction: The law creates inspection pathways for homes built elsewhere. Compliant approvals for manufactured portions must be accepted by the building official where the home is installed. Requirements⁠

Local approval still matters: The law says a municipality “may permit” these homes, subject to applicable land-use requirements. It does not automatically authorize a tiny home on every property.

🏡 New Hampshire ADU Law Update!

Have an older garage or outbuilding you’d like to turn into living space? HB 1079, effective August 31, 2026, could make that easier.

✅ Qualifying structures existing on or before July 1, 2025 can be converted into ADUs even if they don’t meet today’s setback or lot-coverage requirements.

✅ Converting the building into an ADU preserves its legally nonconforming status.

Towns may require proof that the structure qualifies. Building-code, water, and septic requirements still apply.

This could open up opportunities to create space for family or rental income using a building already on your property.

Common client question.. What type of HVAC system do you use in your builds? Heat pumps are the most common especially with our ADU builds but they work just as well in a larger home. A common myth is they don’t perform well in our cold climate. Today’s units can efficiently operate down to double digit negative temps.

New Hampshire law now allows homeowners to build one detached Accessory Dwelling Unit (ADU) on their property in any municipality.

State law requires municipalities to allow detached ADUs with a minimum size of 750 square feet, while each town determines the maximum allowable size.

Homeowners must still comply with local zoning requirements, including setbacks, lot coverage, building permits, and any other applicable local regulations.
