Gag Orders in Family Court Are Illegal—Period. Let's talk...
A court cannot strip a parent of their rights. Any gag order that prohibits you from speaking about your own child or the actions of public officials is a constitutional violation, unenforceable by law, and a per se crime.
Prior restraints on speech are presumptively unconstitutional (Nebraska Press Ass’n v. Stuart, 427 U.S. 539). Family courts are not exempt from this standard!
Such an order is void, not voidable. No judge or opposing counsel has authority to silence protected speech. When they do, they engage in deprivation of rights under color of law (18 U.S.C. § 242). If two or more actors--attorney + judge--conspire to oppress this right secured by the Constitution, it is a criminal conspiracy against rights (18 U.S.C. § 241).
There is no “best interest” exception to the Constitution! If you received a gag order for speaking about your child:
• You have evidence of crimes, not a lawful mandate.
• You are under no legal obligation to comply.
• You can document, report, and speak.
The Constitution does not yield. Assert your rights and hold them accountable!
Thank you, Tanawah Downing, for your unwavering commitment to truth and justice. Your tireless efforts to educate, empower, and stand with families in the face of corruption have made a lasting impact. We are stronger because you aren't giving up!
