When prosecutors use four of six peremptory challenges against jurors under age 25, is that age discrimination under Batson/Wheeler or CCP § 231.7? In Hernandez’s case, the appellate court said no — youth does not qualify as a cognizable class for jury selection, and rejecting jurors for apparent immaturity is race‑neutral. The court affirmed.

Gov. Gavin Newsom will soon fill a vacancy on the California Supreme Court following Justice Martin J. Jenkins' resignation at the end of the month. This appointment carries added weight as Newsom eyes a 2028 presidential run.

Some advocates argue he should appoint a second Latino justice to the seven-member court, while others say he has the freedom to choose from a highly diverse pool of qualified candidates. Leading contenders include 2nd District Justice Gonzalo C. Martinez, 4th District Justice Jose S. Castillo, 1st District Presiding Justice Tracie L. Brown, and 2nd District Justice Lamar W. Baker.

A Los Angeles judge rebuked an attorney for former Dodger Yasiel Puig on Thursday for citing fake AI-generated cases in a court filing, saying he’ll refer the matter to the State Bar. Judge Peter A. Hernandez called the issue “a rising tide of inappropriate AI use” as he heard arguments in Puig’s defamation suit over a documentary that claimed he faced “gambling charges.” Hernandez took the anti-SLAPP motion under submission, calling it a close question of fair reporting privilege.

In a dispute between Thakore / Gopher Media and Melone / American Pizza Manufacturing, the Ninth Circuit (en banc) reexamined whether California’s anti‑SLAPP statute can be used in federal court and whether denials of anti‑SLAPP motions are immediately appealable. The court held that under the collateral order doctrine, such denials are not immediately appealable—and thus dismissed the appeal.
