A federal judge blocked the law a year ago after the Trump administration sued the state, and Texas Attorney General Ken Paxton agreed not to defend it.

Now, Students for Affordable Tuition, La Unión del Pueblo Entero, Austin Community College and student Oscar Silva want a chance to defend the law themselves.

Students, immigrant-rights advocates and Austin Community College asked the 5th U.S. Circuit Court of Appeals on Thursday to let them defend the Texas Dream Act that has helped thousands of undocumented students afford college.

Immigration enforcement has undergone a sea change since President Donald Trump took office for the second time in January 2025, and the effects are being felt across all facets of the federal court system.

“It’s a very, very difficult time to practice law in immigration, and a very difficult time to be an immigrant in this country or have a family member that is an immigrant,” said Jaime Diez, who has practiced immigration and nationality law for 27 years.
