JUST IN—Today we filed a 42 U.S.C. 1983 lawsuit against the St. John’s County Sheriff's Office and others for unlawfully arresting a citizen journalist for “violating” § 843.17 Fla. Stat., ‘Publishing name and address of law enforcement officer.’
The problem?
The statute, § 843.17, was ALREADY held unconstitutional, facially violative of the First Amendment, and permanently struck down by a federal court in 2010. Brayshaw v. City of Tallahassee, Fla., 709 F. Supp. 2d 1244 (N.D. Fla. 2010).
Now we seek an immediate injunction, declaratory
relief, and damages for a violation of my client’s Fourth Amendment rights.
