Our newest post is a concise breakdown of the 2025 California ADU handbook, highlighting the most crucial ADU updates that can impact your property value and rental income. Here are a few of the updated regulations that apply state-wide:
Permitting Speed: Your local jurisdiction is required to review and approve or deny your ADU/JADU application within 60 days if an existing dwelling is on the lot.
Owner-Occupancy Requirements are Prohibited: Local agencies can no longer impose an owner-occupancy requirement on any ADU.
Setback Minimums: A four-foot side and rear yard setback is the maximum a local agency can require for attached or detached ADUs.
Legalizing Unpermitted Units: If your unpermitted ADU or JADU was built before January 1, 2020, a permit cannot be denied for building standards violations unless it's a threat to public health and safety.
These are just the start. There are many other new regulations for ADUs and limitations on what restrictions local jurisdictions can impose. Stop guessing. Start planning your project based on the latest facts.
