It’s Data Privacy Practices this week on Nonprofit Radio. My guest is Jon Dartley with Perlman & Perlman, LLP law firm. Here are highlights of Jon’s advice:
— data breaches are expanding, including among nonprofits
— the largest cost of a breach might be to your reputation
— GDPR applies to any entity collecting data from EU citizens
— you need a GDPR notice on your website +specific opt-ins
— your vendors that have your data must also comply with GDPR
— NY SHIELD Act applies to you if you collect data from NY residents
— NY’s law requires a point person for data security
— breaches usually come from third party vendors
— have an attorney who understands tech review your vendor agreements
— only collect the data you need; access only by those who need it
— look into cybersecurity insurance; also listen to 5/12/17 show
— what’s your policy around use of personal devices for org data
— are your employees being data safe while working from home

This week’s Nonprofit Radio is “Real Estate” and “Racial-Equity DEI.” First, Jane Brody from @Vicus Partners shares her expertise about the real estate market. Then, Tristan Penn with @NTEN reveals racial inequities in Coronavirus outcomes and uses NTEN’s DEI journey to start our conversation about racial and other inequities in the nonprofit community. Here are highlights:

Real Estate
— you may need to allocate more space per employee when you return to your office
— be aware of technology (like screens, tablets), that many people touch
— start thinking about lease renewal 18-24 months before it ends
— look for another deal to use as leverage with your landlord (stalking horse)
— broker fees are built into rental fees
— be in a building where the landlord welcomes your work and clientele
— involve all stakeholders in space decisions: staff, clients, board

Racial-Equity DEI
— Navajo nation Coronavirus cases per capita is just behind NY & NJ
— more than half of Coronavirus deaths are black people
— to start a racial equity convo in your org, it helps to have allies
— there are hard questions to ask and struggle with
— orgs need to avoid tokenism in DEI work; it’s a process, not a committee
— ask yourself the threshold question: should I keep working here
— leadership support is essential to institutional culture change
— don’t miss low-hanging fruit of equity work
— inequity manifests differently at different levels of an org
— there’s always equity work that remains in the journey

5 Questions
— What’s the problem you want help with
— Do key stakeholders agree you need outside help
— What’s the best timing for your org
— Know your budget for money & time
— Are you ready for real engagement with a consultant

Working Virtually
— it’s up to your org to make employees comfortable
— have frequent, intentional communications re: deliverables
— while interviewing, how does the potential employee manage the tech
— don’t leave out the remote employees from casual convos; use your tech
— have your policies in place: communications, security, devices
— onboarding in the physical office helps a lot; meet together at least once a year
— assume good intentions in communications
— look to Slack, Google, Skype (this was 2018, so substitute Zoom)

— we all have disruption within us
— barriers are made of paper maché, not concrete
— we can choose to disrupt that which troubles us
— to be a disrupter: MAP
— Make a commitment
— Action plan
— Persist in your action; it’s hard, not impossible
— you either change something, or you choose it
