Problems with the car

When I read the transcripts from Brown's trial, Detective Al Byrum claimed he had never looked inside the car where Brown claimed Turner had killed Jennifer Evans. How was this possible? Why did the Commonwealth of Virginia DOC prohibit recording equipment into their facilities? Who does it benefit? The public? I don't see how that could be the case if we expose wrongfully convicted inmates and tax payers are paying for their incarceration. Luckily we interviewed all the inmates in the documentary, "Target of Opportunity: The US Navy SEALs and the Murder of Jennifer Evans" before they implemented this draconian policy.

We at vapac agree with the reporter's committee that audio and video recordings should be allowed as it is critical to unveil the conditions #Prisoners experience behind the walls of the VADOC and its secrecy (Quote) Almost a year after the Reporters Committee for Freedom of the Press sent a letter urging then-Gov. Terry McAuliffe and the Virginia Department of Corrections to change the department’s policy to allow journalists to use recording devices during prison interviews, the restrictive policy remains the same. A Memorial Weekend Reminder

Navy SEAL Dustin Turner has spent more than half his life behind bars for a crime he didn’t commit. A former junior deacon at his church and Eagle Scout, his pardon appeal can go before the Virginia governor at any time.

I felt it was fitting on this Memorial Day — when we are thinking of those lost in action—to bring attention to the one Navy SEAL left behind, how I have always viewed Turner, as if he had been abandoned while conducting some clandestine mission.

My involvement in this case stems from, “Target of Opportunity: The Navy SEALs and the Murder of Jennifer Evans”, the documentary I produced in which the person who committed the murder confesses on camera: my camera.

Turner, a SEAL trainee who had completed his training, has spent 22 years of an 82-year prison sentence in prison. Another Navy SEAL trainee, Billy Joe Brown, has admitted he killed Jennifer Evans. First, to me; and then in a Virginia Beach court hearing.

In the words of Dustin’s mom, Linda Summitt: “Dusty is the type of boy any mother would be proud to have. He is the type person who would have died in battle to save others and for his country. There is one man who can release Dusty after so many years. That’s Virginia Gov. Ralph Northam. He can pardon my son.”

In 1995, Turner was about to receive his Trident insignia for completing SEAL requirements. He had received orders to Central America. Then, his world was turned upside down.

Turner was a 20-year-old kid at the time. Now, at 43, he faces the real prospects of never walking out or the Virginia prison system. This is a story the US Navy would prefer go away.

The story of Dusty Turner is both complex and simple at the same time. My involvement is as a former Navy Special Warfare Combat Crewmember (SWCC). I was on active duty in 1995 when I heard the circumstances surrounding the case. It never made sense to me.

It cried for justice, and since retiring, I have spent a decade of my life on the documentary and efforts to get tell the actual facts of this tragic case.

Dusty Turner should have been freed when the real killer, Turner’s colleague in SEAL training, Billy Joe Brown, confessed to the crime. However, a high court over-turned the lower court’s decision to free him.

Under Virginia law at the time, Turner has no possibility of parole, only a gubernatorial pardon. This injustice in the law has since been corrected, but too late to help Turner.

The story’s synopsis goes like this:

Ms. Evans, 21, met Turner in a Virginia Beach, VA club during a vacation in June 1995. Evans disappeared and police zeroed in on Turner and his “swim buddy” Brown. Swim buddy is a designation whereby two SEALs are teamed together.

Both men were convicted, but in 2002, Brown confessed to the crime, saying he could no longer allow an innocent man to pay. It goes without saying that Turner was not blameless.

As Turner’s mother, Ms. Summitt told me, “I’m not saying Dusty is blameless. He made mistakes. He’s paid for them. He adhered to a Navy SEAL code to stand by his colleague, his swim buddy. He was so young, he didn’t know how to react after all they’d done to him”.

My documentary is an attempt to focus attention on the true story of Dusty Turner, a young man once on the verge of proudly displaying a SEAL Trident but now spending his life in prison.

In prison, Turner has been a model inmate, improving the prison system’s environmental management procedures and becoming involved in dog training to help people with disabilities. He’s quiet, respectful, amazingly resilient and hopeful.

This Memorial Day weekend, while we pause to remember our fallen soldiers foreign and domestic, I appeal to Virginia Governor Ralph Northam to also remember one more, Navy SEAL Dustin Turner, left behind not on a battlefield, but behind bars for a crime he simply didn’t commit.

It is time for Dustin Turner to come home.

For the Season 3 finale, @itsjasonflom goes behind bars at Wende Correctional, a maximum security prison in Buffalo, to conduct a searing interview with Andrew Krivak, who was wrongfully convicted with Anthony DiPippo of raping and murdering 12-year-old Josette Wright in 1995. His attorney, Professor Adele Bernhard joins them. No forensic evidence connected Andrew Krivak to this crime, in fact it pointed to Howard Gombert as the killer. Governor is currently serving a long sentence for numerous similar crimes. Mr. Krivak passed 3 separate polygraph tests but the polygrapher lied at the behest of the cops. During the interrogation he was beaten and choked by an officer who was later indicted for doing the same thing to other innocent people. Ultimately, creating for his life he signed a confession that he did not write or even read. Although co-defendants, Mr. DiPippo and Mr. Krivak were convicted in separate trials in Putnam County Supreme Court in 1997, based on the incentivized testimony of a single witness, a crack addict who was threatened with arrest and then offered a deal, and each was sentenced to 25 years to life in prison. In 2016, Andrew Krivak’s legal team sought to introduce newly discovered evidence that ultimately led to the acquittal and release of his co-defendant, Anthony DiPippo, but the motion was denied, largely due to his false confession. In July 2017, the state Appellate Division in Brooklyn said it would hear Mr. Krivak’s appeal of that decision, opening a pathway for a new trial for Mr. Krivak in the coming months. This #memorialday my thoughts are with @freedustyturner who had just earned his status as a Navy Seal when he was wrongfully convicted of a muder that was committed by his best friend. He has steadfastly proclaimed his innocence for over 21 years but he remains behind bars. The real killer has confessed, the evidence is overwhelming plus Dusty has distinguished himself in prison where he has been training service dogs and doing so many other positive things. Google him, watch the amazing film about his case and get involved! #justice #freedom
