Marvel once benefited from arguing that the X-Men weren’t human. Seriously.

In 2003, Toy Biz v. United States settled a bizarre fight over how Marvel action figures should be classified for import tariffs.

U.S. Customs classified many of the figures as dolls representing human beings — which carried a 12% tariff.

Toy Biz argued they should instead be classified as toys representing “non-human creatures” — at just 6.8%.

And yes… the X-Men were part of the case.

To be clear: the court did NOT rule that mutants were legally non-human. This was strictly about how the action figures were classified for tariff purposes.

But for a franchise built around mutants fighting to be accepted by humanity?

The irony is WILD.

So what would Magneto say about this one?
