A woman discovered that her former dog, Max, had been surrendered to a kill shelter by her ex-boyfriend. She had been searching for Max for months after their breakup, and the dog was scheduled for euthanasia the next morning.
Arriving after closing, she found the shelter locked. She broke a window, disabled the alarm, and searched the kennels until she located Max and took him. Shelter staff later discovered the break-in and the missing dog, prompting police to issue a warrant for burglary and theft. Security footage confirmed the break-in.
Three days later, she turned herself in with Max. She faced felony charges but argued that Max had been surrendered illegally by her ex-boyfriend, who had no legal right to give up the dog. Her lawyer proved ownership using vet records, photos, and microchip registration. The court found the ex-boyfriend had acted illegally and dropped charges against her, issuing a warrant for the ex-boyfriend instead.
Max was officially returned to his rightful owner. The woman still faced civil penalties for the property damage caused during the rescue, which she accepted, noting that it had saved Maxโs life. The case highlighted issues with shelter surrender procedures and verification of ownership.
