In 1999, the Supreme Court ruled disabled people have a “right to live in the world” and the right to refuse to be institutionalized.

Although this paved the way for millions to live and receive care at home, we’re still advocating for the far too many people who remain excluded and without the support they need.

Today marks the 27th Anniversary of the Olmstead decision, a landmark disability rights case decided by the U.S. Supreme Court on June 22, 1999.

It established the right of people with disabilities to receive state-funded services in the most integrated setting appropriate to their needs, meaning in the community rather than in institutions.

The landmark 1999 Supreme Court rulingnunity, Olmstead v. L.C. established that the segregation of people with disabilities in institutions is a violation of the Americans with Disabilities Actt(ADA). The cased Elaine originated from the state of Georgia and was brought by two institutionalized / women, Lois Curtis (L.C.) and Elaine Wilson (E.W.), who sued state official Tommy Olmstead.

The Office of Legal Counsel opinion released Thursday said states aren't required by law to integrate mentally disabled patients with their peers by providing community or home-based care. DOJ’s position is that the states do not have to follow Olmstead.

Olmstead is the Olmstead v. L.C. is the 1999 Supreme Court decision that established unnecessary institutionalization as discrimination under the ADA.
