Vilair Fonvil is in Miguelino Joseph is out
SPRING VALLEY — A State Supreme Court Judge Monday afternoon issued an order reinstating for now a village trustee who had been abruptly removed from his position by Mayor Demeza Delhomme.
State Supreme Court Justice Margaret Garvey signed a temporary restraining order to stop Delhomme’s discharge of Trustee Vilair Fonvil, whom Delhomme appointed to the seat he vacated upon becoming mayor Dec. 2.
In her court document, Garvey also made it clear that Miguelino Joseph, whom Delhomme appointed to Fonvil’s seat, has “no rights or (can) otherwise be allowed to take any action as a Spring Valley Trustee until further order of this court.”
Dennis Lynch, a partner of the law firm Feerick Lynch MacCartney, sought the court order Monday afternoon on Fonvil’s behalf.
Lynch, whose firm has been retained as the village’s special counsel by a majority of the village board, said Garvey’s issuance of this order was “unusual” because judges typically prefer to hear arguments from the parties involved before taking action.
He said Garvey agreed with his argument that if Fonvil was removed from the village board, “irreparable harm” would follow because Delhomme would gain control of the five-member village board.
