On Thursday, Judge Matthew Kacsmaryk for the Northern District Court of Texas, Amarillo Division, denied a preliminary injunction and temporary restraining order that Rep. Ronny Jackson (R-Amarillo, TX-13) had requested against California Secretary of State Shirley Weber and California Gov. Gavin Newsom in August.
Jackson’s counsel wrote in August that Weber and Newsom were “unlawfully conspiring to diminish Republican representation in the U.S. House of Representatives” through the California Assembly Constitutional Amendment (ACA) 8, also known as the Election Rigging Response Act (ERRA).
As we previously reported, Texas Gov. Greg Abbott signed HB 4—the Congressional redistricting bill that sought to redraw the U.S. House District maps to add five GOP seats at the request of President Donald Trump—into law on Sept. 5.
In a press release, Newsom’s office said that ACA 8 “allows Californians the ability to adopt a new, temporary Congressional map, in response to the congressional redistricting in Texas, that neutralizes Trump’s power grab.” ACA 8 is the proposed amendment for Proposition 50, which California voters will vote on in the Nov. 4 election.
If Prop 50 passes, the temporary map could add up to five Democratic seats in California, and would last through 2030. If it does not pass, California would continue to use its current congressional map until the routine redrawing of districts after the 2030 census.
