Are you considering selling in Leelanau and/or Benzie County? Here’s what you should know:

Suttons Bay does not have its own municipal Point of Sale (POS) inspection. Instead, the Benzie-Leelanau District Health Department (BLDHD) requires properties with on-site septic systems 3) to undergo a mandatory "time of transfer" evaluation before a sale or ownership transfer can occur. This evaluation checks the functionality of the existing well and septic system to ensure public health and environmental protection.
Steps for a Time of Transfer (TOT) Evaluation in Leelanau County
1 Initiate the Evaluation: Contact the Benzie-Leelanau District Health Department (BLDHD) to begin the process. You may also be able to use a NAWT-certified technician for the evaluation.
2 Application and Fee: Submit an application and pay the required fee, which is based on the system's age and prior inspection history.
3 Evaluation: The BLDHD will inspect the septic system and/or water well to determine if it is functioning correctly and meets current sanitary code standards.
4 Resolution: If the system is found to be non-compliant or defective, repairs or replacement will be required before the property sale can be completed.
Key Considerations:
Scope:�The requirement applies to properties with existing septic systems and/or water wells.
Exceptions:�A written waiver from the BLDHD may be possible if you are removing the residence entirely, adding a spouse to the title, or if the system was installed within the last five years and meets code.
Purpose:�The evaluation is designed to protect public health by ensuring safe drinking water and preventing groundwater contamination from sewage systems.
"Time of Transfer"�This is the common term used in Leelanau County for Point of Sale inspections related to septic and well systems.
