NOTICE OF INTENTION TO SUBMIT AN APPLICATION IN TERMS OF SECTION 24G OF NEMA FOR THE UNLAWFUL COMMENCEMENT OR CONTINUATION OF ACTIVITIES IDENTIFIED IN TERMS OF THE ENVIRONMENTAL IMPACT ASSESSMENT REGULATIONS; AND TO SUBMIT A WATER USE LICENSE APPLICATION

Notice is given, in terms of Section 24(G) read together with sections 24(F) of the National Environmental Management Act 107 OF 1998 that C NEL BOERDERY (PTY) LTD is considering submitting an application for authorisation in terms of Sections 24(G) and 24(F) of the National Environmental Management Act 107 of 1998; for the unlawful commencement of a Dairy Feedlot Facility. The application is for ex post facto authorisation in respect of the illegal activities listed below

Notice is also given in terms of Section 21 (a), (c) & (i), (e) and (g) of the National Water Act, 1998 (NWA, Act No. 36 of 1998). The application and public participation process for the Water Use License Application (WULA) is done according to GN 267 of 2017 of the NWA, Regulations Regarding the Procedural Requirements for Water Use License Applications. The application and public participation process for the S24G National Environmental Management Act, 1998 (NEMA, Act No. 107 of 1998) is done in accordance with the Regulations relating to the Procedure to be followed and Criteria to be Considered when Determining an Appropriate Fine in terms of Section 24G, GN 698 of 2017.

GN 327 of 2014 (amended 2017): Listing Notice 1 Activity 39: The expansion and related operation of facilities for the concentration of animals for the purpose of commercial production in densities that will exceed (i) 20 square metres per large stock unit, where the expansion will constitute more than 500 additional units;

The activity/ies commenced with without the required authorisation

The increase of the concentration of animals in 2017 required an authorization in terms of GN 327 as above.

Parties wishing to be registered as interested and affected parties (I & APs) are requested to forward their objections and comments (with reasons), no later than 8 September 2025, which is thirty 30) days after the publication of this advertisement, on 5 August 2025, for the S24G application, and no later than 9 October 2025, which is sixty (60) days after this advertisement for the WULA, to
