Another SAPS fraud case opened against Japheth Chetty, an attorney at Pather & Pather, for allegedly creating a false Warrant of Ex*****on, colluding with Nabeel Adams (Sheriff Durban West) and a High court registrar to auction a commercial property exceeding R60 million rands.
According to the Court order and Judgement, the commercial property deed and street address was stated incorrectly, but apparently Mr Chetty corrected the property details on the Warrant of Ex*****on and issued it.
Mr. Chetty obtained the Durban High Court registrar to sign his Warrant of Ex*****on for Nabeel Adams (Sheriff) to attach the commercial property and auction the property with a sale date.
Although, Nabiel Adams (Sheriff) has been made aware, he claims the attorney firm has provided indemnity, a common misconception as indemnity does not provide protection from the Board of Sheriffs with alleged criminal acts.
The referred court order is also being brought into question, as Pather & Pather, representing TUHF Limited, have not cited all the trustees of the property trust, a requirement when litigating against a trust.
This case is in addition to a previous fraud case under investigation from 2024 and a previous conviction of a partner at Pather & Pather, Edward Abraham, who was found guilty of corruption after a Hawks Serious Corruption Investigation.
