It's almost 12 years since we lost Senzo Meyiwa. I can confidently state that if Longwe Twala's involvement as the shooter had been established, the accused in the Vosloorus case 636 of 2014 would have been different.
Those who have been closely following the evidence will attest that multiple investigation teams were deployed to investigate the people who were inside the house but their efforts were unsuccessful.
They will further state that Chicco Twala's gun was submitted for ballistics testing and it did not match the projectiles found at the scene.
They will also mention that Mthokozisi Thwala was allegedly subjected to physical assault by a Makhubo team in an attempt to extract a confession but he never confessed.
Lastly, they will note that Captain Buthelezi attempted to extract a confession from Tumelo Madlala but she was unsuccessful.
We know that in 2019, Warrant Officer Makhubo and Captain Buthelezi opened the second docket Cas 375 of 2019 following a disagreement with a team led by Gininda over versions. The team led by Gininda believed there were intruders while Makhubo and Buthelezi believed no intruder entered the house.
Interestingly, the second docket is not about murder but about defeating the ends of justice.
Defeating the ends of justice encompasses misleading authorities, destroying evidence, providing false statements or laying false charges. This charge does not imply guilt of murder on the part of the accused person. It certainly doesn't mean that Longwe Twala is the person who shot and killed Senzo Meyiwa. It seems like Warrant Officer Makhubo intends to draw attention to the discrepancies in eyewitness statements, the incorrect arrest of Zamokuhle Mbatha, the contamination of the crime scene by neighbors and the reported phone call between Tumelo and Hlophe
Thus far no evidence has been presented to indicate that the people who were with Senzo in the house tampered with evidence and there is no evidence to suggest that Senzo was shot by one of them.
The untruths that we perpetually read in some gossip channels continue to be exposed. General Sibiya did not cause any contamination, he did not arrive at the crime scene first, he is not working with Const Sizwe Zungu. Longwe Twala did not shoot himself on the ankle, his father does not own a revolver, a revolver is not the type of firearm that was used, Chicco Twala and Adv Baloi are not brothers. Droplets of blood were found on the dining room floor, a fact attested to by Sgt Mthethwa. Tumelo Madlala also provided testimony to this effect and photographs of the blood were captured. However certain sources have spread false information alleging that no blood was found and that everything was cleaned. I still possess the testimony of Sgt Mthethwa and Tumelo, I can prove this.
Facts are;
*BALLISTICS: A 9mm was used, that's a scientific fact - even the expert of the defense agreed with Mangena on class characteristics of the projectiles that were found at the scene. Scene bullets were linked to Mncube's gun.
*CELLPHONE RECORDS: A connection was found between Kelly's number and a number owned by Accused 5. It is known that a number registered to Accused 3 was pinging at or near the Basotho hostel at a time Zungu said they were there. Ntanzi's number contacted his loved ones (I have pinned a video of his sister on this page). I acknowledge that it's not evidence before court but it indicates that the state is on the right tragectory.
*INDEPENDENT WITNESSES: Neighbors statements suggest that more than one person was involved. This proves that it couldn't have been Longwe because more than one person were seen running towards the park. It is unlikely that Longwe would have run alone towards the park with a gunshot wound on his ankle without leaving a trail of blood.
*THE CONFESSION STATEMENTS: Up to this point there's no evidence that indicates that Ntanzi and Muzi were assaulted or complained of such.
This week the court heard about the Nongoma CAS 163 of 2018. The important thing is, that case does NOT prove Ntanzi's innocence in Vosloorus CAS 636 of 2014 which is before court. Ntanzi confessed in the Senzo Meyiwa case.
