What’s Next for Julius Malema?

EFF leader Julius Malema has been sentenced to five years in prison, a move that could shake both his legal and political future.

Legally, Malema has already appealed the ruling, meaning he won’t go to jail just yet. The final decision now lies with the courts.

Politically, things get even more serious:

According to the Constitution of South Africa, anyone sentenced to more than 12 months imprisonment without the option of a fine cannot serve in Parliament (National Assembly) but only after all appeals are done.

If the appeal fails, Malema could lose his seat in the National Assembly, including his role at the Judicial Service Commission which helps to choose judges.

For now, it’s a waiting game. The courts will decide — and the political impact could be huge.

Matipandile Sotheni, a former police officer and ex Special Task Force member, has appeared in the Brakpan Magistrate’s Court in connection with the murder of Marius van der Merwe.

Van der Merwe, who testified anonymously as Witness D at the Madlanga Commission, was shot outside his home in December.

The case has been postponed the 25th of March 2026 for a bail hearing.
