Partner Content: Personal Liability for Retirement Funds Defaults – A Clear Warning

There is a growing line of High Court judgments which are sending a clear and welcome message: directors, financial officers, and those managing employer finances will be held personally liable, civilly and criminally, for failing to pay over pension fund contributions to the retirement fund. This is in accordance with the Pension Funds Act, 24 of 1956 ("PFA").
