S*x work amendment bill open for public comment

The Criminal Law (S*xual Offences and Related Matters) Amendment Bill of 2022, which seeks to decriminalise s*x work, has been published and is now open for public comment.

The bill proposes the repealing of the S*xual Offences Act (previously Immorality Act), 1957 (Act No. 23 of 1957) and Section 11 of the Criminal Law (S*xual Offences and Related Matters) Amendment Act, 2007 (Act No. 32 of 2007) to decriminalise the sale and purchase of the adult s*xual service.

Justice and Constitutional Development Minister, Ronald Lamola – who addressed media on progress on the bill on Friday – explained that the proposals of the bill are a response to Pillar 3 of government’s National Strategic Plan (NSP) on Gender-Based Violence and Femicide.

“Pillar 3 of the National Strategic Plan… contains a list of key interventions, key activities and indicators. One of the key activities under Pillar 3 is the finalisation of the legislative process to decriminalise s*x work.

“This follows the view that the ongoing criminalisation of s*x work contributes to GBVF, as it leaves s*x workers unprotected by the law, unable to exercise their rights as citizens and open to abuse generally, not least when they approach State facilities for assistance,” Lamola said.

The Minister emphasised that although current legislation and municipal by-laws continue to criminalise the adult practice, this has not “stopped the selling or buying of s*x, nor has it been effective”.

“If anything, [criminalisation] has led to higher levels of violence against s*x workers. In addition, criminalisation affects predominantly women, with the female s*x worker usually being the one who is confronted by law enforcement, but the male client isn’t. The National Prosecuting Authority has also indicated a very low percentage of cases or prosecutions for such transgressions,” he said.

As explained by Lamola, the bill has clauses that seek to:

Repeal the S*xual Offences Act, 1957 and section 11 of the Criminal Law (S*xual Offences and Related Matters) Amendment Act, 2007.
Deal with the expungement of criminal records of persons convicted of, engaged in, rendering or receiving s*xual services from persons 18 years or older.

Handle the transitional provisions pertaining to criminal proceedings relating to s*xual services rendered or received by persons 18 years or older, which were instituted prior to the commencement of this Act.

“It is hoped that decriminalisation will minimise human rights violations against s*x workers. It would also mean better access to health care and reproductive health services for s*x workers, as well as compliance with health and safety and labour legislation. It would also afford better protection for s*x workers, better working conditions and less discrimination and stigma,” Lamola said.

Regulation

Lamola told the briefing that the bill will follow a “two-step approach”, with decriminalisation preceding regulation of the industry.

“It [is] important to deal with decriminalisation first, so as to ensure that s*x workers are no longer criminally charged. This will mean greater protection for s*x workers. Decriminalisation will destigmatise s*x work and enable access to basic services and protection by law enforcement agencies. Existing laws prohibiting children from selling s*x and trafficking for s*xual purposes remain in force.

“With regards to regulation, municipal by-laws would still be able to provide where solicitation in public spaces may or may not take place, for example, prohibiting the selling of s*x in certain areas. This is similar to the prohibition on the location of taverns and shebeens, where there can be restrictions imposed to prohibit trade in residential neighbourhoods, near schools and/or religious buildings,” he explained.

Toddler killed by dog

Thabazimbi – A young family is devastated by the tragic loss of their beautiful little girl who was mauled to death on Friday 22 July by a pit bull owned by their family.

Jereldene King and her two girls Liane Jason (1 year, 7 months) and Miane Jason (three-year-old) live in Nylstroom while her husband Christo Jason works on a farm in Australia.

They were visiting Jereldene’s grandparents in Thabazimbi and arrived in Thabazimbi a week before the horrific incident.

Stay-at-home mom Jereldene doted on her two girls. Her life revolves around them, and she cannot come to terms with what happened.

She never leaves her children with anyone else so when her grandmother volunteered to look after the kids while she goes to a salon, she was reluctant at first.

The pit bull named Rocky was just over a year old and already started showing signs of aggression. A few days before the incident, he apparently killed puppies on the same property.

For safety, Rocky was kept in the back yard and the children weren’t allowed to go near the dog.

The grandmother was busy inside the house when she heard a commotion outside. She ran outside and saw the dog biting onto Liane.

She screamed for help and did everything she could to fight the dog off. In the process, she sustained bite marks on her hands, arms, stomach and legs. One of her legs were also broken in the process and she had to be admitted to hospital.
Six men ran to her aid.

They jumped over the fence and tried to fight the dog off the baby by hitting it with sticks.

A call for help was sent out on the Thabazimbi Emergency WhatsApp group and within five minutes Trauma Rescue and the Thabazimbi Community Policing Forum was on scene.

A vet was also called to the scene and the dog was put down.

Lindy Balfour, a family member said that when she arrived at the scene, she couldn’t get in to assist, as the front door was locked.

All she can remember is that there were many people and that a man handed her the body of the little girl over the fence.

Jereldene was still at the salon when she received the dreadful call, telling her that her baby was killed by the pit bull.

“Liane was a real mommy’s girl. She was very stubborn except when it came to me.

The three-year-old Miane, does not yet understand what happened and is constantly asking where her little sister is,” Jereldene says.

She also urged parents to always be on high alert when their children are around animals, even if they don’t appear to be dangerous.

Christo returned to South Africa the day after the heart-wrenching incident. “We would like to thank everyone who responded to the scene.

Thank you for every message and for the support we have received during this difficult time,” Christo added.
