The Management of the South African Police Service in Gauteng has noted the circulation of a notice by the Station Commander of Boksburg North Police Station regarding the cooperation of the police with a television production company.
The notice emanated from legal advice to the management of the province wherein a concern was expressed of a television crew walking into police stations either requesting the police to es**rt them to conduct sting operations or dropping off people they have arrested for alleged various offences.
The police in Gauteng would like to give clarity on the allegations that SAPS does not want to work with this particular production company:
The Constitution of South Africa enshrines the right to freedom and security of the person (section 12). Arrest, being a significant infringement of this right, is subject to specific legal requirements.
*Arrest Procedure
1. Arrest may be effected with a warrant of arrest obtained from the court in terms of the Criminal Procedure Act (CPA).
2. Arrest may be effected without a warrant of arrest terms of Section 40(1)(a) to (q) of the Criminal Procedure Act 51 of 1977, only in the circumstances stipulated in the section.
However, we have noted with concern certain practices that may not align with legal requirements. These include:
- Effecting arrests without warrants or witnessing the commission of an offense
- Arresting illegal foreign nationals without verification by the Department of Home Affairs
- Conducting entrapments that do not comply with Section 252(A) of the CPA
- Unlawfully searching people or property without search warrants
- Dumping suspects at police stations without providing arrest statements
We would like to emphasise that investigative journalists do not have the authority to arrest suspects. If evidence of a crime is uncovered, we encourage anyone to report it to SAPS and cooperate with police investigations. Trained detectives will then investigate, gather evidence, and apprehend suspects as necessary.
The SAPS is open to collaborating with television production houses, but this must be done through SAPS Head Office and Provincial Corporate Communication and Liaison’s Film and Television Section. Any visits to film inside police stations also require prior arrangement with Corporate Communication and Liaison.
If a production company has safety concerns about filming in a particular area, they may request police visibility in writing to the station commander of the relevant policing precinct, at least 14 working days prior to the filming date. It is worth noting that police officers will not be static at the set but will instead conduct patrols in the area.
SAPS will work with production companies in a manner that respects the law and individual rights.
