You can be arrested for harassing foreigners in South African hospitals!
Health Minister Dr. Aaron Motsoaledi has reminded the nation that Section 27 of our Constitution guarantees healthcare for everyone — whether South African or foreign, documented or undocumented. This includes reproductive health services like contraception, maternal care, and safe pregnancy termination.
Speaking at a recent health policy event in Pretoria, Motsoaledi said there’s no legal room for discrimination in hospitals. Denying or intimidating someone because of their nationality is not only against the law — it goes against Ubuntu and puts public health at risk.
Human rights groups such as Doctors Without Borders and the Treatment Action Campaign have welcomed the reminder, saying many migrants face stigma and admin barriers that stop them from getting care.
While some critics worry about strain on the health system, the Minister insists:
> “A healthy population benefits everyone.”
The Department of Health is now working on plans to improve access for vulnerable communities while preparing for the National Health Insurance (NHI) rollout.
