Courts | Vodacom and Makate Reach Out-of-Court Settlement in “Please Call Me” Saga
Johannesburg - Vodacom has announced that it has reached an out-of-court settlement with Nkosana Makate, finally bringing an end to the long-running legal battle over the invention of the “Please Call Me” service.
In a statement to shareholders released on Wednesday, Vodacom confirmed that its Board had approved the settlement agreement, which has already been accounted for in the Group’s interim financial results for the six months ending 30 September 2025. These results are expected to be published later this month.
As part of the settlement process, Vodacom formally withdrew its appeal lodged with the Supreme Court of Appeal, and also filed a notice with the High Court to abandon the 8 February 2022 judgment in the matter.
The telecommunications giant, however, did not disclose the financial terms of the agreement reached with Makate.
The development marks the conclusion of a decades-long legal dispute that began when Makate, a former Vodacom employee, claimed compensation for conceiving the “Please Call Me” idea — a free messaging service that allows users without airtime to request a call back.
Earlier this year, the Constitutional Court granted Vodacom leave to appeal a Supreme Court of Appeal decision that had ordered the company to pay Makate more than R40 billion. In his final judgment before retiring, Justice Mbuyiseli Madlanga upheld Vodacom’s appeal, referring the compensation issue back to negotiation.
With this settlement, both parties appear to have closed one of South Africa’s longest and most contentious corporate legal battles.
