HARD COPY safety files NOT required BY LAW… DSF to the rescue!
Yes, under South African law, you can use a fully digital safety file accessed via a QR code, provided it meets specific operational and accessibility requirements.

While the Draft Construction Regulations 2025 explicitly formalize and embrace electronic H&S files, the transition is already supported by existing legislation. Under Section 16(1) of the Electronic Communications and Transactions (ECT) Act 25 of 2002, information is not denied legal force or validity solely because it is in the form of a data message.

However, before discarding hard copies completely, you must ensure your QR code system meets the following strict compliance criteria on-site:
Legal and Practical RequirementsImmediate Availability: The files must be instantly accessible to inspectors, clients, or auditors on site without delays caused by logins or system crashes.
Uninterrupted Power and Signal: You must have a reliable internet connection or a local offline digital backup to handle cellular network drops or load shedding.
Device Accessibility: A dedicated device (like a site tablet) should be available for workers or inspectors who do not have a smartphone to scan the code.
Electronic Signatures: Appointed forms, risk assessments, and daily checklists must utilize legally compliant electronic signatures that trace accountability.
Proof of Training: Digital site inductions and attendance logs must securely store verifiable data showing the worker completed the session.
