State Adds 6 More Charges Including Money-Laundering Against Gagash And Charlotte Tibana

| The State has applied to add six additional money-laundering charges to the existing 35 charges against Peter Nonyane, popularly known as Gagash, and Charlotte Tibana during their bail proceedings at the Polokwane Magistrate’s Court which would increase charges the couple need to answer from 35 to 41.

The State told the court that the proposed charges relate to accused number two and are brought in terms of Section 4 of the Prevention of Organised Crime Act.

The defence opposed the application, arguing that the charge sheet does not clearly indicate where the alleged transactions took place.

The defence questioned whether the alleged offences occurred in Johannesburg, elsewhere in Gauteng or another province, raising concerns regarding the court’s jurisdiction.

The State argued that money-laundering charges can be prosecuted regardless of where the alleged transactions occurred within South Africa.

The State referred to the proposed Count 36, which relates to an alleged transaction of R110 000 on 6 July 2018, as part of its argument.

The six additional charges have not yet been formally added, as the court is still expected to make a ruling on the State’s application.

The bail proceedings against Nonyane and Tibana continue.
