COURTS ARE NOT A SUBSTITUTE FOR THE WILL OF THE PEOPLE

Chief Justice Mumba Malila has urged judges of the Constitutional Court to prepare for the critical role they will play in resolving electoral disputes as Zambia moves towards the 2026 general elections.

Speaking at the official opening of a specialised training programme for judges in Livingstone, Dr Malila said the Judiciary is central to democratic processes, with judges now often determining the legitimacy of elected leaders.

“In a democracy, elections are the most orderly and widely accepted means of choosing leaders. Yet political leadership is no longer decided solely by voters. Judges, far removed from polling stations, are now being called upon to determine who holds power,” he said.

Dr Malila said the courts are not a substitute for the will of the people, but are expected to uphold peace, fairness, and legality during politically charged periods.
