Morgue moves Lungu’s body to secret location

THE body of former president Edgar Lungu has been quietly moved from the place it had been deposited in South Africa to a secret location.

In a letter seen by Kalemba, Two Mountains Burial Services, the funeral parlour initially responsible for the body, informed the lawyers of the Zambian government that the remains were transferred on June 20 to Thom Kight and Company, another funeral service provider.

Although the letter identifies the new funeral service provider by name, the exact location where Lungu’s body is being held has been deliberately kept under wraps.

Two Mountains said the decision was taken purely for security reasons after the family and the funeral parlour began receiving multiple public enquiries and noticed increased social media activity surrounding the location of the body.

“This decision was taken solely for security reasons, as we had by that time received multiple public enquiries and expressions of concern regarding the storage location of the body.”

“Additionally, various comments had begun circulating on social media regarding this sensitive matter,” wrote the funeral service provider.

Two Mountains requested that the information be kept on a “strictly need to know basis” due to the heightened media attention and the delicate nature of the situation.

The company disclosed that the Lungu family has been informed of the transfer and is said to be fully aware of the new arrangements.

The new funeral provider, Thom Kight and Company, has been instructed to release the body only with court approval.

The legal fallout began shortly after, when lawyers for the Zambian government rushed to the Pretoria High Court on July 2, seeking to urgently amend a previous court order that they believed didn’t go far enough in preventing the removal of the body from South Africa.

In their court filing, the government’s attorneys, VFV Attorneys, explained that they had received information suggesting there were plans to relocate the late former president’s remains outside the country. Given the urgency, they approached the court without notifying the other parties, a legal move known as applying ex parte.

The matter was heard in private by Justice Myburgh AJ, who granted the variation of the order, making it clear that the body cannot be moved beyond South Africa without court approval.

Both the Lungu family’s lawyers and Two Mountains had previously believed the original court order did not explicitly block such a transfer, but the latest ruling has now removed that ambiguity.

VFV Attorneys have since confirmed that the updated court order has been shared with the parties involved, including Thom Kight & Company and that the body may not be released to anyone unless authorised by the court.

EXAMINATION MALPRACTICE

July 30, 2025 – Mazabuka

On July 29, 2025, at 18:50 hours, Mazabuka Police Station received a report of examination malpractice from Mr. Boyd Haluyasa, aged 57, of Nanga Research Center and Headteacher at Nanga Secondary School. He reported and brought in Mr. Lathen Choobe, aged 19, of Hillside Compound, Mazabuka, who was found writing the GCE examination on behalf of Mr. Elvis Lwiindi of Mulonga Extension Compound, Mazabuka.

The incident occurred on July 29, 2025, between 10:00 hours and 14:00 hours at Nanga Secondary School in Mazabuka District.

Brief facts of the matter are that on the said date, around 10:00 hours, the suspect, Mr. Lathen Choobe, was found writing the Biology examination on behalf of his friend, Mr. Elvis Lwiindi. After completing the paper, he mistakenly submitted the answer sheet along with the NRC bearing the names of Elvis Lwiindi to the invigilator, who was also the Headteacher.

Realising the mistake, the suspect approached the Headteacher and asked to open the sealed examination documents to retrieve the NRC, but the Headteacher refused. The Headteacher then advised Mr. Choobe to report the matter to Nanga Police Post in order to obtain a police report for the purpose of acquiring another NRC.

Upon reaching Nanga Primary School, where NRC issuance was taking place, Mr. Choobe failed to give details matching those on the NRC. Instead, he began calling the actual owner of the NRC to obtain the information. This raised suspicion, and the registration officer informed the police.

The police then interviewed Mr. Lathen Choobe, who confessed that he was writing the examination on behalf of Mr. Elvis Lwiindi, who had paid him K1,000.

The suspect, Mr. Lathen Choobe, has since been detained at Mazabuka Police Station while investigations have been instituted to apprehend his accomplice, Mr. Elvis Lwiindi.

JUST IN: GOVERNMENT HAS NO RIGHT TO THE REMAINS OF EDGAR LUNGU SAYS FAMILY

The Lungu family submitted to the Gauteng High Court that the Zambian Government lacks authority to repatriate the late President’s remains as demanded by the Attorney General.

Attorney General, Mulilo Kabesha, asserted that the State is entitled to repatriate the body for a state funeral and burial at Embassy Park in Lusaka, Zambia.

He claimed that Zambian law dictates the manner and place of burial of a previous Zambian Head of State.

However, the family’s lawyers dismissed Kabesha’s arguments, stating that the Attorney General’s claim is based on the Benefits of Former Presidents Act, 1993 [chapter 15 of the Laws of Zambia], and the traditions and customs of the State.

The family rejected the application, stating the Zambian Government lacked legal authority to compel the repatriation of President Lungu’s remains in South African law.

The lawyers argued the application was legally unsustainable, factually flawed, and impermissible under the South African Constitution.

The family contended the relief sought undermined their constitutional and common law rights, including dignity, family life, and cultural practices.

They asserted the application invoked Zambian protocol and customs with no extra-territorial effect and not enforceable in South Africa.

Even if there were Zambian law, it wouldn’t be enforceable in South Africa.

The family argued President Lungu’s benefits as a former Head of State were revoked before his death, making him a private citizen.

During this period, he sought financial support from family and friends and left Zambia for medical treatment in South Africa, fearing political negligence.

The family claimed the revocation was deliberate and weakened President Lungu, contributing to his health decline and untimely passing.

The South African Government confirmed its respect for the family’s decision to inter President Lungu in South Africa and would not oppose the burial.

A copy of this communication was submitted as Annexure “EL15” in the Opposing Affidavit.

The Attorney General’s efforts to assert authority over the late President Lungu’s remains were legally and morally wrong.

The family, as surviving next-of-kin and the only ones aligned with the late President Lungu’s wishes, are entitled to the remains.

The opposition to the repatriation application stems from South African legal principles, the late President Lungu’s human rights, and the constitutional values of dignity, autonomy, and respect for the family’s cultural and personal choices.

Defilement Suspect Has Case to Answer

A 44-year-old man of Lusaka’s Kabanana Township, RICHARD MWANZA, has been found with a case to answer in a matter where he is accused of defiling seven children from the same area.

Lusaka Magistrate, CHRISPIN HAMPUNGANI, in his ruling says the State has established a prima facie case against MWANZA, warranting him to be placed on his defence.

When the matter came up for ruling, Magistrate HAMPUNGANI said he was satisfied that sufficient evidence had been presented during trial to require a response from the accused.

Meanwhile, defence lawyer, JIMMY MWAANGA, informed the court that his client will give sworn evidence in support of his defence and intends to call three additional witnesses.

The defence team also applied for an adjournment to allow adequate preparation.

Magistrate HAMPUNGANI has since adjourned the matter to July 30, 2025 for commencement of defence.

MWANZA is facing seven counts of defilement for allegedly having carnal knowledge of children under the age of 18.

During trial, the children testified and identified MWANZA as the individual who allegedly defiled them.

The Lands and Deeds Registry (Amendment) Bill of 2025, presented as a mechanism to strengthen integrity in Zambia’s land administration, risks achieving the opposite. While it purports to clean up fraudulent or irregularly issued Certificates of Title, it introduces a dangerously centralised authority by empowering the Chief Registrar to cancel land titles administratively, with limited judicial oversight and weak institutional safeguards. In a country where land remains one of the most contested and emotive issues, historically linked to identity, inequality, and economic opportunity, such power must be treated with caution.

It is always shocking how lawmakers believe the best way to resolve any loopholes in law is by increasing grip by increasing regulation by government. It’s always this passion for regulation. It is shocking!

One can accept enhanced regulation if the current laws are being followed and they’re failing. Unfortunately, most Zambians will tell you that enforcement of laws in Zambia is so poor that you wonder whose idea it is to introduce new ones. Maybe start by enforcing what already exists correctly?

Under the proposed Section 57A, the Chief Registrar may, upon application by an "interested person," cancel a Certificate of Title if it was issued in contravention of the law, in error, or obtained through fraud or misrepresentation. The procedure laid out gives the Registrar 90 days to act on the application, and if the titleholder fails to respond within 30 days, cancellation may proceed without further inquiry. Even when responses are filed, the Registrar retains wide latitude to decide whether they are satisfactory or not. Aggrieved parties may appeal to the Minister, and only thereafter to the courts or the Lands Tribunal.

This structure presents several problems, honestly. First of all, it collapses the judicial principle of the right to be heard before an impartial tribunal by concentrating quasi-judicial power in the hands of an administrator. This reverses the hierarchy of legal redress, instead of the courts being the primary arbiters of land disputes, they become the last resort, accessible only after exhausting administrative channels that may already be tainted by bias or political interference. Let’s not act like government structures are not compromised.

The Bill fails to provide a clear legal standard or burden of proof that an applicant must meet when requesting cancellation. What qualifies as “fraud” or “misrepresentation”? Can historic political land allocations be challenged under this clause? Could a legitimate buyer be stripped of land rights because a prior transaction, unknown to them, is deemed irregular? Without specificity, the Bill opens the floodgates to malicious or politically motivated applications, especially in rural Zambia where record-keeping is poor and land ownership is often informal or contested.

Placing appeals under the jurisdiction of the Minister, before they can proceed to the courts, politicises what should be a purely legal question. This is particularly alarming in a context where government has previously been accused of using state institutions to target political opponents, settle business rivalries, or reallocate land to allies. The appearance of neutrality is as important as neutrality itself in a democracy, and this Bill undermines both.

To be clear, Zambia does need stronger mechanisms to tackle fraudulent titling, which has plagued the Ministry of Lands and led to painful disputes, especially in peri-urban and newly developing areas. The solution, arguably, cannot lie in removing legal protections for those who hold Certificates of Title in good faith. It must lie in institutional strengthening, digitisation of land records, transparent dispute resolution mechanisms, and investment in the Lands Tribunal, not in giving unchecked powers to a single bureaucrat or Minister.

Historically, land has been a point of injustice in Zambia, from colonial-era dispossessions to post-independence inequities and unregulated informal settlements. Land reform must therefore be rooted in justice, equity, and rule of law. Bill 13 of 2025, in its current form, risks entrenching uncertainty and opening the door to executive overreach under the guise of administrative efficiency.

Parliament must do more than rubber-stamp this Bill. It must scrutinise it rigorously, consult widely with legal experts, civil society, traditional leaders, and landowners. What is at stake is not just administrative tidiness. We’re talking about the very foundation of land rights in Zambia.
