KWACHA AND KABUSHI BY-ELECTION CHALLENGED

The Constitutionality of the elections held in Kwacha and Kabushi Constituency has been challenged in the Constitutional Court.

The Institute of Law, Policy Research and Human Rights, Green Party President Peter Sinkamba and Governance Activist Isaac Mwanza have today petitioned the Constitutional Court to declare the election held on 21st October, 2022 in Kwacha and Kabushi as unconstitutional, illegal and null and void.

In a petition filed Tuesday, the parties have said the Statutory Instrument signed by the three Commissioners of the Electoral Commission of Zambia that prescribed the date of election was unconstitutional and illegal.

The petitioners also argued that the decision to include candidates who had resigned on the ballot after the Constitutional Court had 20th October 2022 determined that the proceedings from which the High Court made an order stay election had lapsed contravened the Constitution and is illegal.

The petitioners have also asked the Constitutional Court to maintain its previous decision in which the Court stated that a resignation under the Constitution cannot be rescinded In the absence or a decision to rescind a resignation.

UPND’S CONDUCT WORSE THAN PF’S

…their lying lips won’t save them from the pending Armageddon – Dr Fred M'membe

Leader of the fastest growing Socialist Party Zambia Dr Fred M’membe has lamented that the UPND is doing the very unacceptable things that made Zambians kick the PF out of power in last year’s elections.

Dr M’membe said the New Dawn Administration is in some cases doing worse things than the PF did.

He highlighted some of the bad things as corruption, abuse of state institutions and electoral violence among other things.

The opposition leader said this in an interview today.

“All the unacceptable things the PF were criticized and removed from power for, that is corruption, abuse of state institutions, electoral violence and malpractices, tribalism, nepotism and so on and so forth, the UPND is doing…and in some cases even worse than the PF,” he said.

Meanwhile, Dr M’membe warned that the UPND’s lying lips, their doubled tongued mouths will not save them from the pending Armageddon.

“What makes them feel if PF was rejected for these things they will be exempted and get away with it? Their lying lips, their doubled tongued moths will not save them from the pending Armageddon, the last battle between good and evil before the day of judgement,” he said.

HOW CAN SERIOUS ACTS OF CRIMINALITY BE LIMITED TO GENDER BASED VIOLENCE?

There was relief in the country when Pamela Chisumpa who was abducted in April this year was rescued together with thirteen others. This relief was accompanied by very sad feelings about and reflections on the pain and humiliation they had to endure. But how can these serious acts of criminality be limited to Gender-based violence? With growing inequality, unemployment and general economic difficulties, we should brace ourselves for more and more criminal activities.

Let us not take a simplistic approach to this matter. Captivity always causes trauma as they often witness or experience humiliation, threats and, in some cases, violence. We stated that these violent acts will have a long-lasting impact for the families and those abducted. Pamela and the other young ladies need a lot of help to stabilise themselves psychologically, socially and otherwise.

PF APPALLED BY ECZ’S DECISION TO HOLD KABUSHI, KWACHA BY-ELECTIONS DESPITE COURT ACTION

On 24th August, 2022 the Electoral Commission of Zambia (ECZ) issued a circular to the effect that those whose elections in Kabushi and Kwacha constituencies were nullified would not be allowed to contest the elections.

Our candidates went and filed their nominations which were rejected by the returning officer and we proceeded to court. The elections were stayed by the High Court and the stay is still in force.

Today ECZ has issued a statement that they will proceed with the elections in the two constituencies.

We find the decision of the Electoral Commission of Zambia (ECZ) to proceed with the by-elections in Kabushi and Kwacha constituencies without first awaiting the outcome of the court processes, an abrogation of the Constitution and gross contempt of court.

This is the very behaviour by the ECZ that caused the current legal impasse that the country is experiencing over the Kabushi and Kwacha by-elections. The behaviour of ECZ is not only illegal but extremely reckless and irresponsible and is a recipe for serious public discordant.

It is now clear to the Zambian people that the ECZ has no desire whatsoever to allow the people of Kwacha and Kabushi to have a free and fair election and vote for candidates of their choice.

ECZ and the public are fully aware that the issues of the by-elections in Kabushi and Kwacha are subject of active court processes to which the ECZ itself is part to. There are currently three court processes concerning the Kwacha and Kabushi by-elections;

1. The High Court gave a specific order, ordering ECZ to stay the elections in Kwacha and Kabushi.

2. The Court of Appeal ordered a stay of the delivery of the judgment of the High Court pending determination of the appeal filed by the Attorney General and the ECZ itself and

3. There are proceedings in the Constitution Court on the interpretation of the 90 day period set by the Constitution concerning the period of holding of by-elections.

ECZ and the public may wish to be reminded that the Court of Appeal has ruled, suspending the running of the days until it makes its ruling on the matter.

Clearly ECZ is working on the instructions of the UPND to disenfranchise Hon Bowman Lusambo, Hon Joseph Malanji and the Patriotic Front from participating in the Kabushi and Kwacha by-elections.

Zambians must brace themselves for a complete degeneration of Constitutionslim and the total breakdown of the rule of law as the UPND gets more and more desperate to resuscitate its fading popularity.

We wish to inform our members and the nation at large, that the Patriotic Front has instructed its lawyers to commence appropriate legal action against ECZ including citing the ECZ commissioners for contempt of court in their individual capacities.

Teachers boycott class after Nyau whips female colleague

Teachers at Mbozi Day Secondary School in Vubwi have abandoned classes after one of the female teachers was allegedly whipped by a masquerade on her way to school.

Teachers were demanding to be addressed by Chief Pembamoyo, of the Chewa in Vubwi.

Vubwi District Commissioner Given Sakala confirmed the incident occurred yesterday but declined to reveal the identity of the teacher who was whipped.

SPEAKER NELLY MUTTI’S ASSETS UP BY K39 MILLION IN A YEAR

Speaker of the National Assembly Nelly Mutti's networth has gone up to K419 million in 2022 from K380 million in 2021.
This is according to her latest declared assets and liabilities before the office of the chief justice.

The speaker is among the four public office holders that have declared their assets and liability for the year 2022 among 166 public office holders.

The other three include Deputy Speaker of the National Assembly Malungo Chisangano, Second Deputy Speaker Moses Moyo and Energy Minister, Peter Chibwe with a total assets declared being K57.5 million and 30,000 dollars.

According to the parliamentary and ministerial code of conduct, all public office holders are supposed to declare their assets and liabilities within thirty days after the appointment and within thirty days after each anniversary of their appointment, to the office of the Chief Justice.
