Until it is PUBLISHED, a statement cannot be DEFAMATORY.

A statement can only be DEFAMATORY if it is shared with a THIRD PARTY, or another person other than the publisher and the initial receiver (or victim).

For instance, if you privately text someone on Facebook and claim they are professionally incompetent, it would be tricky for the victim to sue for DEFAMATION, because the initiator of the incompetence claim didn't PUBLISH the statement.

BRIEF:

Police in Lusaka have arrested the man accused of causing the death of Kabwata MP Levy Mkandawire.

Alick Jetta Kalengo has been charged with four offenses, with
the most outstanding offense being causing death by dangerous driving.

Meanwhile, his wife, who was also on the BMW vehicle that squeezed the MP against the wall fence to his residence, has been released.

The release of Jane Mwale follows substantiated revelation that contrary to earlier reports, Kalengo is actually the one who floored the pedal.

WHY C5 IS A CRIMINAL ORGANIZATION

LET'S face it. The legal principle of presumption of innocence is very clear on how suspects should be treated: They are innocent until proven guilty by a legitimate court of law.

But because this country's governments have been so lame, they have opted to trash that principle by granting a group of overzealous, blood-thirsty street thugs access to lethal AK-47 rifles, which they have been using to terrorize innocent citizens.

What is even more disturbing to note is that these dull street thugs with state guns do not even posses a single set of BASIC homeland security skills. All they have been told is to kill and drive away.

In many instances, they kill defenseless citizens who do not even know where the trigger is located on a gun!

By so doing, they p**s off on many laws guiding the Police Service, such as the Zambia Police Act, which does advise when an officer should fire at a suspect.

Worse, the so-called C-5 don't even have a legal backing for their barbaric acts.

So why should the Zambia Police continue covering up for this group of blood-thirsty street thugs?
