Lungu’s remains held in South African state facility as police probe delays repatriation!

The body of former President Edgar Lungu is still lying in a South African state facility pending investigations by the South African Police Service (SAPS) into the cause of his death.

The Zambian government has obtained a court order to have Mr. Lungu’s remains repatriated to Zambia for a state funeral, following a protracted legal battle between the government and the Lungu family.

However, according to documents seen by Diamond News, Two Mountains Burial Services (PTY) Limited, which was initially keeping the body before the court order for its transfer, says it has been advised by the Zambian government’s attorney that the remains will not be immediately repatriated.

This is to allow SAPS to continue with investigations, with the remains now moved to a state facility.

Two Mountains Burial Services has also stated that it is not prepared to accept possession of the late President’s remains.

The company has further urged the Lungu family to ensure that they do not request the return of the remains to their custody.

Meanwhile, the Lungu family has obtained an order from the South African Supreme Court of Appeal halting the High Court order that allowed the transfer of Mr. Lungu’s body to the Zambian government for a state funeral.

Mr. Lungu died on June 5, 2025, in South Africa. Since his death, his body has not been buried due to an ongoing impasse between his family and the Zambian government.

SOUTH AFRICA’S SUPREME COURT HALTS TRANSFER OF ECL'S REMAINS, ORDERS REVERSAL

South Africa’s Supreme Court of Appeal o has halted the removal of former President Edgar Lungu’s remains, following an earlier decision by the Zambian government to transfer the body to a South African state facility.

Government had earlier confirmed that the High Court of South Africa Gauteng Division, Pretoria had ruled in favour of handing over the remains of the Sixth Republican President to the Zambian authorities.

Attorney General Mulilo Kabesha said the development followed the family’s failure to proceed with their case before the appellate court.

Mr. Kabesha stated that the remains had since been moved from Two Mountains Burial Services to a facility managed by the South African government, in line with the August 8, 2025 court ruling which directed that the body be released to facilitate repatriation and burial in Zambia.

He added that government would engage the family to finalise burial arrangements, with the nation to be informed in due course.

However, in a dramatic turn of events, the appellate court intervened and ordered an immediate halt to the process.

In an urgent ruling delivered last evening, the Supreme Court of Appeal of South Africa directed that the late President’s remains be returned to Two Mountains Burial Services, effectively stopping the repatriation.

Family spokesperson Makebi Zulu confirmed the development during a press briefing, stating that the court had granted a stay and ordered both governments to reverse any actions already taken.

In a further escalation, the court has directed both the Zambian and South African governments to appear before it and show cause why they should not be cited for contempt of court.

The intervention follows an urgent application by the family, which prompted the court to issue a last-minute stay, halting and reversing the transfer of the remains.
