KAMBWILI LOSES APPEAL, HEADS TO JAIL OVER TRIBAL REMARKS

Kasama, Zambia – Former Information Minister Chishimba Kambwili is set to begin serving a five-month jail sentence with hard labour after the Kasama High Court dismissed his appeal against a 2023 conviction for hate speech.

In a ruling delivered today by a panel of three High Court judges, the court upheld the Subordinate Court’s decision that found Mr. Kambwili guilty of making tribally inflammatory remarks during a live radio broadcast on Radio Mano in August 2021.

⚖️ Conviction Upheld

Kambwili was originally convicted on November 30, 2023, under Section 70(1) of the Penal Code, which prohibits hate speech based on tribe or place of origin. His remarks were deemed to show hatred and contempt toward the Tonga-speaking community.

The High Court today ruled that:

> “The appellant’s grounds of appeal lacked merit. The sentence was appropriate under the circumstances and does not warrant interference.”

The State, through the National Prosecution Authority (NPA), had filed a cross-appeal seeking a stiffer penalty, arguing that the offense had threatened national unity and peace. However, the court opted to uphold the original sentence.

🚨 Immediate Imprisonment Ordered

Mr. Kambwili has now been ordered to begin serving his sentence immediately, effective July 14, 2025.

The court stressed that freedom of expression does not extend to inciting tribal divisions, and that Zambia’s legal system will continue to uphold the values of national cohesion and respect for diversity.

A Member of Parliament yesterday raised an issue before the National Assembly over Chawama lawmaker Tasila Lungu-Mwansa's prolonged absence in the National Assembly.

Yesterday, Zambezi East MP Brian Kambita rose on a point of order, questioning whether the House was in order to consider Ms Lungu as its member when she has no intention of coming back to Zambia as submitted by her mother, Mrs Esther Lungu, in the South African High Court.

Mr Kambita contended that Ms Lungu’s absence in the National Assembly has deprived the people of Chawama representation.

“Last week, Mrs Esther Lungu submitted in the South African High Court that her family do not intend to come back to Zambia as they feel unsafe. One of the members of this House, who is also a member of that family by the name of Tasila Lungu Mwansa, Member of Parliament for Chawama Constituency, is also out there as a member of that family. I ask you to make a ruling,” Mr Kambita submitted.

In response, Speaker of the National Assembly Nelly Mutti has reserved her ruling regarding the continued absence of Chawama Member of Parliament Tasila Lungu in the House.

Ms Lungu is currently in South Africa mourning the death of her father, Edgar Lungu, Zambia's six President who died on June 5, 2025.

Mr Lungu was supposed to he buried on June 24 in South Africa where he died from while seeking medical attention.

His family, following an impasse with the Zambian Government, resolved to bury Mr Lungu, 68, from South Africa.

But Attorney General Mulilo Kasbesha filed an injunction in South Africa halting the planned burial, a plea which the court granted.

The South Africa Court is yet to hear the main court case in which Mr Kabesha wants the former President remains to he repatriated to Zambia for burial..

Lusaka, Zambia – President Hakainde Hichilema has called on the United Arab Emirates (UAE) to expand its investment footprint in Zambia beyond the mining sector, citing lucrative opportunities in energy, health, and tourism.

Speaking during a courtesy call by UAE Minister of State Shakhboot Bin Nahyan Al Nahyan at State House, President Hichilema emphasized that Zambia is open for business, and reiterated his government’s commitment to removing bureaucratic barriers that hinder economic progress.

“Zambia is ripe for investment. We must diversify our partnerships beyond mining and build joint ventures in sectors that can uplift our people,” he said.
