"Murume wako itori brother yangu ndosaka ma surname azofanana" this was the defense of a woman who was informed to pay US$8000 in damages by the High Court. The woman (Natasha) was alleged of having an affair with a married man (Martin) that led to the eventual dissolving of a 20 year marriage. The wife who filed the lawsuit had assistance of neighbors who testified that the two where seen together and Martin was introducing the small house as his wife.
The husband had informed his wife that his ancestors wanted him to take a second wife and thus began the distancing in their marriage. The small house could not provide DNA evidence to support her claim that she was related to the husband. The court established that the lawsuit was valid and that the smallhouse had caused damage to the institution of marriage through the adulterous affair. The wife revealed she started seeing expensive gift receipts and encountered various call logs between Natasha and her husband.
The court declined the husband's claims that the marriage was dissolved due to the wife's juju as this was baseless. In essence the evidence provided outweighed the defense claims which where not backed up by evidence thus US$8000 in damages was awarded to the wife who suffered significant emotional and financial harm due to the affair.
