When one of her students tumbled out of their chair Thursday afternoon, it wasn't a new or entirely unexpected experience for Arapaho Charter High School English teacher Heather Pasquinelli. The office-style chairs she has in her classroom weren't the best of quality to start with, and are getting older; some are stained, some tilt sideways, and sometimes kids have even flipped over backwards. If one parent is not enrolled, and the other – and the children – are, should tribal court have jurisdiction over their custody dispute?

It’s a question posed by a Riverton man in a federal lawsuit, which names Wind River Tribal Court itself, several current and former judges, along with the Eastern Shoshone Department of Family Services and others “acting under the color of tribal authority.”
